of the peace for Talbot county that he will diligently and faith-
fully, according to the best of his judgment, perform the duties
of commissioner of said town, without favor, partiality or pre-
judice; and a certificate of such qualification shall be returned
by the said justice to the commissioners, to be filed and recorded
among their proceedings.

102. If any of the said commissioners during the year for
which he was elected shall die, resign, remove from said county,
or be otherwise disqualified, an election shall be held to fill the
vacancy.

103. If the inhabitants at any time neglect to make an elec-
tion at the time required, the power of electing .commissioners
shall not therefore cease, but the power of said inhabitants in
that respect shall continue, and the president and commissioners
for the time being shall remain in office until such election shall
be held.

104. The said commissioners shall have power to meet and
adjourn from time to time as they shall think proper, and shall,
at their first meeting after an election, choose from their own
body a president, who shall preside at all meetings of the com-
misBioners, vote on all questions before them, and remain in
office until superseded by the appointment of a new president,
after a new election of commissioners.

105. They may appoint a clerk and prescribe his duties, and
allow him such compensation as they may think proper, and all
ordinances passed by them shall be entered by the clerk in a
book to be kept by him for that purpose, and shall be open at
all times for the inspection of any person interested, and copies
of all ordinances shall be set up in the most public places in said
town.

106. They may determine upon and regulate all matters
relating to the building of wharves in said town, regulate the
moving of rafts, arks and boats, and prevent all nuisances and
obstructions in the waters of the creek and harbor in front of
the town.

107. They may open, close, grade and level streets and alleys,
and remove all nuisances and obstructions from the same, and
prevent encroachments thereon, by building or otherwise.
