discharge the duties of superintendent, and shall pay over, lay
out and expend all moneys which he may receive as the super-
intendent of that part of the United States' road within the
limits of this State, as directed by law, then the above obligation
to be void, otherwise to be in full force and virtue in law."

109. The superintendent shall appoint toll-gatherers at the
several gates established on said road, and may remove any toll-
gatherer by him appointed for misbehavior ih office, and appoint
another in his place.

110. Each toll-gatherer shall annually give bond, with security
approved by the superintendent, to the State of Maryland, in
the penalty of one thousand dollars, with the following con-
dition: "The condition of the above obligation is such, that if
the above bound ---- shall at the end of every three months
from the time of receiving his appointment, and at all other
times when thereunto required, pay over well and truly to the
superintendent of the national road, the whole amount of tolls
by him collected as toll-gatherer, then the above obligation to
be void, otherwise to be in full force and virtue in law."

111. The salary of the toll-gatherer at the gate between
Frostburg and Cumberland, shall be two hundred and fifty
dollars per annum; the salary of the toll-gatherer at the gate
west of Frostburg, shall be two hundred dollars per annum; the
said salaries to be retained and paid out of the tolls collected on
said road.

112. The said toll-gatherers shall settle their accounts every
throe months from the time of their appointment, and at all other
times when thereunto required by the superintendent, and shall
at all. times pay over to the said superintendent, on demand, the
amount of tolls by them received, deducting for their salaries, as
directed in the preceding section.

. 113. The amount of tolls, after deducting therefrom the
expenses, and charges of collection, and compensation of the
superintendent, shall be applied, under the direction of the super-
intendent, to the repair and preservation of the road in such
manner and under such regulations as ho from time to time may
prescribe and direct, and to no other purpose, and if any surplus
shall remain beyond the actual expenseu of preserving and TC-
pairin^ said road, and the pay of the superintendent and toll*
