RIGHTS, POWERS AND PREROGATIVES OF THE COMMIS-
SIONERS.

Rights and
powers of the
Commission'rs

59. The Commissioners shall have full power, right and
authority to do and perform and to provide for the doing and
performing of any and all of the matters and things herein-
after mentioned, and to prohibit, forbid and prevent the doing
of any of the matters and things which they are herein author-
ized to prohibit, forbid and prevent, and to impose and pre-
scribe any penalties which herein they are invested with
power to impose and prescribe; and the provisions herein shall
in no wise interfere with, restrict or forbid the exercise of any
rights, privileges or prerogatives which are provided for, con-
ferred and bestowed directly or by necessary implication in
any of the provisions or sections of the charter other than the
esent section, that is to say "The Commissioners shall be
they are hereby authorized and empowered:"

Health of the
town and
protection of
property.

(1.) To pass and enact all by-laws and ordinances necessary
or proper to promote and preserve the health of the town and
the people thereof, and to protect and to safeguard the town
generally and every section and part of it, and to protect and
safeguard the property belonging to the town as a corporate
body and as well the property of the residents thereof, and
also to protect and safeguard persons who are not residents
and the property of such non-residents, while they or their
property are within said town.

Prevent
nuisances.

(2.) To forbid and prevent nuisances, to define and describe
what shall be a nuisance, and to declare any existing thing
within said town to be a nuisance which prejudices or is
liable to prejudice the health of the people thereof, or of any
considerable number of same, and to prescribe and appoint
means for removing any nuisance or nuisances, and to enforce
the use of such means, and to prescribe penalties for a refusal
or failure to remove any nuisance after the Commissioners
have ordered the removal thereof.

(3.) To establish, regulate and supervise night watches and
patrols.

Build and keep
in repair
drains and
sewers.

(4.) To open, to have opened, to build or construct, to
enclose, to keep open, to regulate and to keep in repair all
necessary and useful drains and sewers, and to demand and
obtain for the bailiffs, employees, workmen and laborers in
the service of the town the right to enter any private property
and premises for the purpose of improving the condition of
any such drains or sewers, for opening the same, when they
have become closed or obstructed, to rebuild or repair them
