proper Conveyance to any Person or Persons who shall bid and give
the best and highest Price therefor as fully and effectually to all
Intents and Purposes as if the said Mary Philpot was herself in her
own Right Seised of and in the like Estate in such Lands and other
the Premisses respectively as the said Brian Philpot was seized of
at the Time of his Death And the monies arising on such Sale or
Sales to lay out apply and dispose of for and towards the payment
and Satisfaction of the Debts of the said Brian Philpot which he
did owe at the Time of his Death and still remain due and unsatisfied
and to the Satisfaction and Discharge whereof the Personal Estate
of the said Brian Philpot will not extend and the necessary Charges
attending the said Sale And to the End that the said Sale shall be
fairly made and the money arising therefrom be duly applied
Be it Enacted That the said Mary Philpot shall before such Sale
or Sales give Bond with sufficient Sureties to the Deputy Commis-
sary of Baltimore County for the Time being in the same Manner
and Form as is Usual in Cases of Intestates Estates (which said
Bond shall be by him transmitted to and lodged in the Prerogative
Office) with Condition to the same That the said Mary Philpot shall
dispose of account for the Monies arising by such Sale or Sales
produce a Certificate from the said Deputy Commissary of such
Security having been given And also that the said Mary Philpot
shall within twelve Months after any Vendue as aforesaid account
with the Commissary for the Produce of such Sale in the same Man-
ner as if the same was properly personal Estate to be paid according
to Law and the Meaning and Intention of this Act
Provided always and be it Enacted That this Act shall not extend
to impower the said Mary Philpot to burthen or charge the Orphan
or Orphans of the said Brian Philpot or any Person or Persons
claiming by from or under them or any of them with any General
or other Warranty than against the said Brian Philpot and his Heirs
