Pounds fifteen shillings and four pence Current Money and four
thousand and ninety three Pounds nineteen shillings and eight pence
Sterling That over and above these Sums there are other Debts on
Bonds and on unsettled and open Accounts the Balances of which
she apprehends and believes will be considerably against the Estate
That She hath appraised the Estate of her said Husband and re-
turned an Inventory thereof amounting to nine hundred Pounds
fifteen shillings and eight pence half penny Currency and a List of
sperate Debts amounting to six hundred and sixty nine Pounds
eleven shillings and eight pence Pennsylvania Currency consisting
of two Bonds Past for the Consideration of a Tract of Land sold
but not conveyed That there appears to her no other Debts due to

the said Estate except some unsettled Accounts which she appre-
hends are desperate That her said Husband did in his Lifetime
write down and deliver to an Attorney a Memorandum or Minutes
in Writing wherefrom to draw his last Will and Testament and
therein did appoint and direct sundry of his Lands and real Estate
to be sold for the Payment of his Debts That the said Will was
not drawn or any other Will ever executed That the said Brian
Philpot her Husband died seized and Possessed of a considerable
real Estate great Part thereof lying adjacent to Baltimore Town
and by her late Husband laid out in Lotts and Streets That the
Personal Estate being insufficient for the Payment of the Debts and
the greatest Part of them being on Interest should the Payment be
delayed till the Arrival of the Heir at Law to Age the same would
exceed the Amount of the real Estate and prayed that a Law might
pass to enable her to make Sale of the real Estate of her said Hus-
band or so much thereof as would be sufficient to pay and satisfy the
Debts due from the said Estate and remaining unpaid after the
Personal Estate is paid away And Whereas the Allegations in the
said Petition appear to this General Assembly to be true

Be it therefore Enacted by the Right Honourable the Lord Pro-
prietary by and with the Advice and Consent of his Lordships Gov-
ernor and the upper and lower Houses of Assembly and the Author-
ity of the same That the said Mary Philpot shall be and is by Virtue
of this Act impowered to set up and expose to sale by Way of publick
Vendue to the highest Bidder in convenient Parts and Parcels the
whole if necessary of the real Estate of the said Brian Philpot and of
which the said Brian Philpot died seized and possessed at the Time
of his Death (three Months Notice of the Time and place of such
Vendue being first given in the Maryland and Pennsylvania Gazettes)
And such Lands or such Part or Parts thereof as may be sufficient to
raise money to satisfy and pay the Debts due from the said Brian
Philpot as aforesaid and all the Estate Right and Title of the said
Brian Philpot therein, respectively at the Time of his Death to make
over and convey by Indenture of Bargain and Sale or by any other
