Charles County Court Proceedings, 1668—1670. 209 att all times for ever hereafter lawfully quietly and peacably have Liber D hold use occupy possess & enjoy the sd Land & all & singular the before granted prmises wth their rights members & Appurtenances & have & receive & take the rents issues & pfitts thereof to his or their owne pper use & behoofe wthout a manner of lett trouble eviction or interruption of or by the sd Bennett his heirs Exectrs or Admistrs or of or by any of them or of or by any othr person or persons wtsoever The rents or services shall henceforth fro time to time for & in respect of the forementioned prmises hereby sold shall grow due & payable to the Cheife Ld or Lds of the Fee or Fees thereof for & in respect of his or their Seignory or Seignorys only excepted & foreprized In witnesse hereof the pties first above mentioned to these Indenturs have interchanghly set their hands & seals the day & yeare first above written. Thomas Bennet 0 Signed seald & Delivered in prsence of George Thompson Henry Moore Henry Bonner Nicholas Emanson acknowledgeth this fowling Conveyance to Mr Stephen Montague This Indenture made the 29 of July 1669 Betweene Nicholas Emanson of Charles County on the one pte & Stephen Mountague of the same County & pvince on the othr pte Witnesseth tht the sd Nicholas Emanson for & in Consideration of 5000 lb of Tobacco & Cask to him in hand pd by the sd Stephen Montague the recpt whereof he doth by these prsents acknowledge & himself to be therewth fully satisfied Contented & pd & throf & thrfro & of & frO every pte & pcell throf doth acquit release & discharge the M Montague his heirs exetrs & Admistrs Hath bargained sold alien'd enfeofed set over & confirmd & by these prsents doth bargaine aliene assigne enfeofe sett over & confirme unto the sd Step: Montague all tht pcell of Land call'd Howland lying on the north side of Piscatoway river on the south side of a Creeke in the sd river caled Mattawoman or St Tho: Creek begining at a marked Oake by the Creek side in an Indian feild runing East & by north up Creek & swap for breadth 100 pearchs to a marked Oake in the woods bounding on the east by a line drawn South & by east from the sd Oake for lenght 320 perchs on the south by a line drawn west & by south from the end of the South & by east line for bredth 100 perchs on the west by a line drawn north & by west fro the end of the west & by south line to the first marked Oake on the north by the sd Creek qt 200 Acres more or less together wth all houses edifices buildings barnes stables Gardens Orchards yards backsids Easmts tenemts meadows fedings pastures woods underwoods ways pfitts Comodities & Appurtenancs wtsoever to the sd Land belonging or in any wayes appertaining & also all the estate right title interest use pperty claime & demand of 17 |
