parcell of hoggs, to the quanty of thirtie or more, & the sd hoggs
being wanting about fiue weeks the sd Depont would haue done his
endeauoe to haue fownd them & haue brought them home, But John
Chearman who was the Ouerseer of the seruants & Crop, would not
lett him, But sayd The hoggs would come home of themselues, &
further sayth not.
Willm Samford deposeth the same.
Vppon these Crosse accons of John Chearman & Willm Boreman
Concerning a Crop of Tob &c: att Nangemy, wch Boreman sayth was
spoyled through his the sd Chearmans neglect & carelesnes, wch the sd
Chearman denyeth, producing wittnesses who affirme the contrary,
affirming tht the Crop, if spoyled, was soe occasioned rather through
his neglect, & breach of promise or couent These accons are putt to
a Jury.
Warrt to the Sheriffe for Jury. Ret forthwth
Sheriffe returneth his writt, & warned

The Jury being agreed, & hauing long time debated the allegaons
on both sides doe returne their Verdict Viz.
Wee find to Chearman plf Twelue hundred pownds Tob. dammage
wth cost of suite.
And tht Boreman plf had noe iust cause of accon, Therfor a non
suite in tht accon, wth Cost.
The Court commanded the Verdict to be entred for the Judgmt

Vppon the demand of the plf, for 338l Tob & Cask, The deft being
call'd & not appearing, eyther by himselfe or Attorney, Judgmt is

thirty & Eight pownds of Tob & Cask, wth costs of suite.

Vppon this demand, It is ordered tht the Attatchmt be continued, &
determined att the next Prouinciall Court.

Nonsuite is graunted to George Goodrick, wth Costs, agst Samuel

Cask, This Cause is sent downe to the County Court in rt Maries
