(293) And the afs.d James by William Middleton his attorney Comes and defends the force and Injury when &C.a and saith that he Cannot deny the action afs.d of him the said Samuel nor but that he did assume upon himself in manner and form as the said Samuel against him hath Complained nor also but that the said Samuel hath Sustained Damages by means of not Performing the Promises and Assumptions afs.d to one Thousand and fifty Six Pounds of Tobacco as the said Samuel above in declaring supposes Whereupon the said Samuel by his attorney afs.d Prays Judgment and those Damages so acknowledged together with his Costs and Charges by him about his suit in this Part laid out and Expended to him to be adjudged Therefore it is Considered by the Court here that the said Samuel do Recover against the said James his Damages afs.d to one Thousand and Fifty Six Pounds of Tobacco above acknowledged as also the Sum of Two Hundred five Pounds & one Quarter of a pound of Tobacco for his Costs and Charges by him about his suit in this Part laid out and Expended on Def.t in Mea his assent by the Court here adjudged and the said James in Mercy &Ca
Charles County ss.t Moses Drape late of Charles Mariner was attached to answer unto Jeremiah Aderton of a plea of Trespass upon the Case and so forth And Whereupon the same Jeremiah Aderton by Jeremiah Chase his attorney Complains that whereas the said Moses the Day of In the year of our Lord One Thousand Seven Hundred and forty Eight at Charles County afs.d was Indebted to the said Jeremiah Aderton In the sum of Eighteen Pounds Virginia Currency of the Value of Twenty Eight Pounds Sixteen shillings Maryland Currency for divers articles lying Properly in an account as by the Particular account thereof herewith into Court brought may appear and being so thereof Indebted the the afs.d Moses Drape in Consideration thereof afterwards to wit the day and year afs.d at the County afs.d upon himself assume and to the said Jeremiah then and there faithfully Promised that he the afs.d Moses Drape the afs.d Sum of Eighteen Pounds Virginia Currency of the Value of Twenty Eight Pounds Sixteen Shillings Maryland Currency to the said Jeremiah Aderton when thereunto afterwards he should be Requested well and truly would Content and Pay Nevertheless the afs.d Moses his Promise and Assumption afs.d not Regarding but minding and fraudulently Intending the same Jeremiah Aderton in this Part Craftily and Subtilly to deceive and defraud the afs.d Moses Drape the said Sum of Eighteen Pounds Virginia Currency of the Value of Twenty Eight Pounds Sixteen Shillings Maryland Curr.y or any Part thereof to the same Jeremiah Aderton hath not Paid nor him for the same in any sort Contented altho the afs.d Moses Drape afterwards to wit the first day of December In the year of our Lord one Thousand Seven Hundred and Forty Eight and often afterwards at Charles Co.ty afs.d by the same Jeremiah Aderton hath been Requested but the same to him hither to to Pay or him for the same in any sort to Content hath Altogether Refused and Still doth Refuse to the Damage of the same Jeremiah Aderton Thirty Six Pounds Virginia Currency of the Value of Fifty Seven Pounds Twelve shillings Maryl.d Curr.y & therefore suit is brought & so forth John Doe Pled.s &C.a & Rich.d Roe |
