(292) March Court Anno Domini 1748 Pounds of Tobacco for divers Articles lying Properly in an account as by the Particular Account thereof herewith into Court brought may appear and being so thereof Indebted the afs.d James Eaton in Consideration thereof afterwards to wit the day and year afs.d at the County afores.d upon himself assumed and to the said Samuel then and there faithfully Promised that he the afs.d James the said sum of one Thousand and Fifty Six Pounds of Tobacco to the said Samuel when thereunto afterwards he should be Requested well and Truly would Content and Pay Nevertheless the afs.d James his Promise and Assumption afs.d not Regarding but minding and fraudulently Intending the same Samuel in this Part Craftily and Subtilly to deceive and defraud the afs.d James the said sum of one Thousand and fifty Six pounds of Tobacco or any part thereof to the same Samuel hath not Paid nor him for the same in any sort Contented altho the afs.d James afterwards to wit the Tenth day of December In the year of our Lord one Thousand Seven Hundred and forty Eight & often afterwards at Charles County afs.d by the same Samuel hath been Requested but the same to him hither to to pay or him for the same in any sort to Content hath hither to Altogether Refused and Still doth Refuse to the Damage of the same Samuel Hanson Two Thousand One Hundred & Twelve Pounds of Tobacco and therefore suit is brought and so forth John Doe Pled.s &C.a & Rich.d Roe at 12/6 payable 1747 James Eaton Next Octr Dr 1747 at 12/6 PC.t
Whereupon into Court here in his Proper person Comes Luke Davis of Charles Co.ty Planter and becomes Pledge and Security for the said James that if it should happen the said James In the Plea afs.d should be Convict that then the said Luke yeilded and Granted that as well the Damages afs.d as all Costs which to the said Samuel in this Part should be adjudged of his Lands and Chattles should be made and Levied to and for the use of the said Samuel that if it should happen that the s.d James the Damages and Costs afs.d to the said Samuel should not Pay or his Body into the Custody of the Coroners by Reason thereof Render (And) |
