(294) March Court Anno Domini 1748 D.r Capt.n Moses Drape Anno 1748 Per Contra Cr
Charles County ss.t January 23.d 1748 Then Came before me the subscriber one of his Lordships Justices of the Provincial Court of Maryland Ann Aderton who made Oath on the Holy Evangelists of Almighty God that this account as it here stands stated is Just and true and that she had Reced no Part or Parcel security or satisfaction for the same more than what Credit is given for Except some other articles which she is willing to allow on his making it appear to the best of her Knowledge Sworn to before Geo Dent Whereupon into Court here in his Proper Person Comes William Eilbeck of Charles County Merchant and becomes Pledge and Security for the said Moses that if it should happen the said Moses in the plea afs.d should be Convict that then the said William yeilded and Granted that as Well the Damages as all Costs which to the said Jeremiah in this Part should be adjudged of his Lands & Chattles should be made and Levied to and for the use of the said Jeremiah that if it should happen that the said Moses the Damages and Costs afs.d to the said Jeremiah should not Pay or his body into the Custody of the sheriff by Reason thereof Render And now here at this day to wit the Second Tuesday in March afs.d Comes here as well the said Jeremiah Aderton by his attorney afs.d and the said Jeremiah by his said Attorney Prays that the s.d Moses to his Declaration against him may answer and the afs.d Moses by Thomas Clark his attorney afs.d Comes and defends the force and Injury when & so forth And afterwards to wit the same Second Tuesday in March afs.d as well the said Jeremiah as the said Moses do agree & submit that the whole matter In Variance between them be Determined by Richard Harrison and Walter Hanson Gentlemen Referees by the Court hereof the Consent of the Parties afs.d Especially appointed Whereupon it is said to the said Richard and Walter by the Court here (that) |
