(281) Tobacco for Costs that had Accrued and that further should Accrue in Prosecution of the Premises and When the same they have attached or any Part thereof that they should have it before the Justices of the Lord Proprietary of his Next County Court to be holden at Cha.s Town on the Second Tuesday in March Next then and there to be Condemned according to Law to and for the use of the said Samuel unless the said Thomas should Come then and there by himself or Lawfull attorney and answer unto the said Samuel of a plea of Trespass upon the Case and that by Good and Lawfull men of their Bailywick they should make known to the Person or Persons in whose hands they should make the same attachm.t that he she or they be and appear before the Justices of the said Lord Propry at the Place and time afs.d to shew Cause if any he she or they have why the sum in their or any of their hands attached should not be Condemned according to Law and the said Sam.l have thereof Execution if &C.a And how they should Execute that Writ that they should make known to the Justices afs.d at the time and Place afs.d and that they should have then and there that Writ and the Names of those before whom they should make the same known &C.a And now here at this day to wit the Second Tuesday in March afs.d Comes the said Samuel by Jeremiah Chase his Attorney and offers himself against the said Thomas Richards In the Plea afs.d and Samuel Chunn one of the Coroners afs.d Return to the Court here the Writ afs.d thus Indorsed Viz.t Charles County ss.t I hereby Certifie to the Worshipfull the Justices within mentioned that by Virtue of the within Writ to me directed the twelfth day of November 1748 that on the Seventeenth day of November 1748 I attached on the Plantation of the within ment.d Thomas Richards for the use of the within mentioned Samuel Hanson Sundry Goods as the Effects of the said Richards as by a schedule hereto Annext and I have made Known to the above Garnashee that he be and appear before the Justices within mentioned at the Time and Place within Prescribed to shew Cause if any he had why the same should not be Condemned according to Law for the use of the within mentioned Sam.l Hanson before John Thomas and Neffell Leach Good and Lawfull men of Bailywick as I am hereby Commanded So Answers Sam: Chunn Coroner With which Return was Returned the following Schedule Viz.t Charles County ss.t We the subscribers being Legally summoned and Sworn by Samuel Chunn one of the Coroners for the Right Honourable the Lord Proprietary on the County afs.d to appraise the Effects of Thomas Richards for the use of Samuel Hanson Gentleman High sheriff of the County afs.d do appraise the same as follows Viz.t one small Gelding 450 In Testimony whereof we have hereunto set one hogshead of Tobacco our hands and Seals this 17.th day of Nov.r 1748 Ditto in Bulk and hanging John Thomas Jun.r (SS) Quantity yet unknown Neffel Leach (SS) his John X Kidwell (SS) mark his Thomas X Hayes (SS) mark And the said Thomas Richards the Quantity of Tobacco in the schedule afs.d ment.d altho solemnly Called Comes not but makes Default Whereupon the said Samuel by his Attorney afs.d Prays Condemnation of the Schedule afs.d with Execution thereof to (him) |
