(282) March Court Anno Domini 1748 Him to be adjudged Therefore it is Considered by the Court here that the said Samuel have ^thereof^ Condemnation of the Schedule afs.d so as afs.d Attached by the Court here adjudged according to the form force and Effect of the Act of Assembly in those Cases late made and Provided and that the said Samuel have thereof Execution if &C.a Mem.o Jeremiah Chase Secy on Condemnation
Charles County ss.t Thomas Johnson late of Charles County Planter was attached to answer unto Samuel Hanson Esq.r High sheriff of Charles County of a plea of Trespass upon the Case and so forth And Whereupon the same Samuel by Jeremiah Chase his attorney Complains that whereas the said Thomas the fourteenth day of Sept.r In the year of our Lord One Thousand Seven Hundred and forty Seven at Charles County afs.d was Indebted to the said Samuel In the Sum of Twelve Hundred and Seventy Six p.ds of Tobacco for divers Articles lying Properly in an Account as by the Particular Account thereof herewith into Court brought may appear and being so thereof Indebted the afs.d Thomas Inconsideration thereof afterwards to wit the day and year afs.d at the County afs.d upon himself assumed and to the said Samuel then and there faithfully Promised that he the afs.d Thomas the afs.d sum of Twelve Hundred and Seventy Six Pounds of Tobacco to the said Samuel when thereunto afterwards he should be Requested well and Truly would Content and Pay Nevertheless the afs.d Thomas his Promise and Assumption afs.d not Regarding but minding and fraudulently Intending the same Samuel in this Part Craftily and Subtilly to deceive and defraud the afs.d Thomas the afs.d Sum of Twelve Hundred & Seventy Six Pounds of Tobacco to the same Samuel hath not Paid nor him for the same in any sort Contented altho the afs.d Thomas afterwards to wit the Tenth day of June In the year of our Lord One Thousand Seven Hundred and forty Eight and often afterwards at Charles County afs.d by the same Samuel hath been Requested but the same to him hitherto to Pay or him for the same in any sort to Content hath hither to altogether Refused and Still doth Refuse to the Damage of the same Samuel Hanson Two Thousand five Hundred and Fifty Two Pounds of Tobacco and therefore suit is brought and so forth John Doe Pled.s &C.a & Rich.d Roe |
