March Court Anno Domini 1746
(65 Part thereof nor for the same in any sort Contented but the same to them to Pay hath hither to Altogether Refused by Virtue of which assignment and of the Act of Assembly Action hath accrued to the said Thomas & John to have and Require of the said Corn.s the aforesaid sum of Seventy Six pounds four shillings money aforesaid Yet the afs.d Cornelius altho' often Required the aforesaid sum of money to the said Thomas and John or to either of them hath not Rendered or paid but the same to them to Render or pay hath hither to Altogether Refused and Still doth Refuse to the Damage of the said Thomas and John one Hundred Pounds Current money Maryland and therefore they bring suit and so forth and they bring hereinto Court as well the Writing Obligatory aforesaid as the Writing of Assignment aforesaid which the Debt and Assignment thereof as aforesaid Testify the dates whereof are the Several Days and years aforesaid John Doe Pled.s &C.a & Rich.d Roe And the said Cornelius Sandford by his attorney comes and Defends the force and Injury when & so forth and Prays a hearing of the Writing Obligatory afs.d and it is Read unto him and he prays a hearing of the Condition of the said obligatory and it is Read unto him in these Words ow the Condition of the above obligation is Such that if the above bound Cornelius Sandford Thomas Morriss & John Delozier their Heirs &Ca do Will and truly pay to Luke Morriss his Heirs or Assigns the full and just suing Thirty Eight pound Two Shillings Current Money of the Province afs.d at or before the 20.th day of March Next Ensuing then the above obligation to be Void otherwise to Remain in full force & Virtue in Law On the Back of which bond Were the following Endorsements Viz.t Received August y.e 14.th 1746 of Thomas Morriss and John Delozier Thirty Nine pounds Maryland Currency in full for the within Bond & Interest Luke Morriss I Assign over unto Thomas Morriss & John Delozier the within Sureties all my Right Title Interest Claim and Demand whatsoever to the within Bond for Value Received as Witness my hand and Seal this 15.th day of august 1746 Luke Morriss (H) Sealed & Deliv.d In the presence of J Chase W.m Middleton August 15.th 1746 Then Came before me the Subscriber one of his Lordships Justices of the peace for Charles County the within Named Luke Morriss (Who) |
