Court Anno Domini 1746
(57 Sum of Two Thousand Eight Hundred and Twenty Two pounds of Tobacco then we Impower any attorney in any Court of Record in the Realm of Great Britain France or Ireland or within the Province of Maryland or other his Majesties Dominions to a plea for us at the Suit of the above Named Wm Middleton his Exrs Admrs or Assigns and thereupon to Receive a Declaration on the above obligation and Confess Judgment by Nildicit Cognovit Actionem Nonsum informatus or otherwise hereby Releasing all the Errors that may happen on the said Judgment suing out Execution thereon or in any of the proceedings thereunto Relating Which being Read and heard the said Thomas by his Attorney afs.d Comes & defends the force and Injury when &C.a and the said Attorney saith that he is not informed by the s.d Thomas of any Answer to be given for the said Thomas to the said William in the Premises nor hath he any other thing to Say thereof in Barr or Preclusion of the Action afs.d of him the said William whereby the same W.m Remains against the s.d Thomas thereof undefended Therefore it is Considered that the said W.m Recover against s.d Thomas his Debt & Costs afs.d and his Damages by Occasion of Detaining that Debt to four Hundred and Eighty one pounds of Def.t in Mea Tob.o to the same W.m on his Assent by the Court here Adjudged and the said Thomas in Mercy &C.a Memorandum the plf Releases the penalty on payment of Premisses Interest & Damages
Charles County ss.t James Freeman late of Charles County Innholder otherwise Called James Freeman Ordinary Keeper of Charles County was Summoned to Answer unto William Middleton of a plea that he render unto him five Thousand Six Hund.d & forty four p.ds of Good Sound Merchantable Leaf Tob.o in Cask w.ch to him he Owes & Unjustly detains &Ca And Whereupon the said W.m by Jeremiah Chase his Attorney Says that whereas the s.d James on the Twelfth day of November In the year of our Lord one Thousand seven Hundred and forty six at Charles County afs.d by his Certain Writing Obligatory with the seal of him the said James Sealed and herein Court produced whose date is the day and year afs.d Acknowledged himself to be held and firmly bound unto the said Will.m Middleton in the sum of five Thousand Six Hundred and forty four pounds of Good Sound Merchantable Leaf Tobacco in Cask to be paid to the s.d W.m when thereunto afterwards he should be Requested Nevertheless the said James altho' often Requested the said sum of Five Thousand Six Hundred and forty four pounds of Good Sound Merchantable Leaf Tobacco in Cask or any part thereof to him the said W.m hath not paid or in any sort Contented but the same to him the said W.m to pay or in any sort to Content hath hitherto Altogether Refused and Still doth Refuse to the Damage of him the said W.m Eleven Thousand Two Hundred and Eight pounds of Good Sound Merchantable Leaf Tobacco and therefore Suit is brought and so forth Pled.s &Ca And the afs.d James by Henry Darnall his Attorney Comes and defends the force and Injury when &Ca and prays a hearing of the Writing Obligatory and it is Read unto him he also prays a hearing of the Condition of the same Writing and it is Read unto him in these Words Vizt (The |
