Anno Domini 1746 The Condition of the above Obligation is such that if the above bound Thomas Llanphier and James Freeman their Heirs Ex.rs or Adm.rs do or shall Cause to be paid unto the said W.m Middleton his Certain Attorney Ex.rs Adm.rs the full and Just sum of Two Thousand Eight Hundred and Twenty Two p.ds of Good Sound Merchantable Leaf Tobacco in Cask in Charles County afs.d at or upon the Tenth day of February Next Ensuing the date hereof with Lawfull Int for the same then the above obligation to be Void Else Remain in full force and Virtue in Law but if default be made in the payment of the said Sum of Two Thousand Eight Hundred and Twenty Two pounds of Tobacco then we Impower any Attorney in any Court ^of^ Record in the Realms of Great Britain France or Ireland or with in the Province of Maryland or other his Majesties Dominions to appear for us at the suit of the above Named William Middleton his E.rs Adm.rs or Assigns and thereupon to Receive a Declaration on the above obligation and Confess Judgment by Nildicit Cognovit Actionem Nonsum informatus or otherwise hereby Releasing all the Errors that may happen on the said Judgment freeing out Execution thereon or in any of the proceedings thereunto Relating Which being Read and heard the said James by his Attry aforesaid Comes and defends the force and Injury when &C.a and the said Attorney saith that he is not informed by the said James of any Answer to be given for the said James to the s.d W.m in the Premises nor hath he any other thing to say thereof in Barr or Preclusion of the Action aforesaid of him the said William whereby the same William Remains against the said William thereof undefended Therefore it is Considered that the s.d William Recover against the said James his Debt & Costs afs.d and his Damages by Occasion of Detaining that Debt to four Hundred and Eighty One pounds of Tobacco to the Def.t in Mer same W.m on his Assent by the Court here Adjudged and the said James in Mercy &Ca Mem.o the plf Release the penalty on payment of Prin.l Int & Damages
Charles County ss.t Joseph Nally late of Charles County Planter otherwise Called Joseph Nally of Charles County Planter Was summoned to answer unto Mess.rs Daniel Stephenson and Henry Steel of a plea that he render unto them in the just and full sum of Three Thousand Two Hundred and fifty four pounds of sound Tob.o in Cha.s Coty which to them he owes & unjustly detains And Whereupon the said Sgtephenson & Steel by Henry Darnall their Attorney Say that whereas the said Joseph on the Twenty Seventh day of September In the year of our Lord one Thousand Seven Hundred and forty Six at Charles County afs.d by his Certain Writing Obligatory with the seal of him the said Joseph Nelly Sealed and herein Court produced whose date is the day and year afs.d Acknowledged himself to be held and firmly bound unto them the said Stephenson & Steel in the said sum of Three Thousand Two Hundred (&) |
