March Court Anno Domini 1746 Which being Read and heard the said John by his Attorney afs.d Comes & Defends the force and Injury when &Ca and the said attorney saith that he is not informed by the said John of any Answer to be given for the said John to the said George in the Premises nor hath he any other thing to say thereof in Barr or Preclusion of the Action afs.d of him the said George whereby the same George Remains against John thereof undefended Therefore it is Considered that the said George Recover against the said John his Debt & Costs aforesaid and his Damages by occasion of Detaining that Debt to four Hundred and Eighty One pounds of Tobacco to the same George on his Defend.t in Mer Assent by the Court here Adjudged and the said John in Mercy &Ca
Charles County ss.t Thomas Llanphier late of Charles County Brewer otherwise Called Tho.s Llanphier Brewer of Charles County was Summoned to Answer unto Wm Middleton of a plea that he render unto him five Thousand Six Hundred and forty four pounds of Good Sound Merchantable Leaf Tobacco in Cask which to him he owes & unjustly detains &Ca And Whereupon the said W.m by Jeremiah Chase his Attorney says that whereas the said Thomas on the Twelfth day of November in the year of our Lord One Thous.d Seven Hundred and forty Six at Charles County afs.d by his Certain Writing Obligatory with the seal of him the said Thomas Sealed and herein Court produced whose date is the day and year afs.d Acknowledged himself to be held and firmly bound unto the said W.m Middleton In the sum of five Thousand Six Hundred and forty four pounds of good Sound Merchantable Leaf Tobacco in Cask to be paid to the said W.m when thereunto afterwards he should be requested Nevertheless the said Thomas Altho' often Requested the said Sum of five Thousand Six Hundred and forty four pounds of Good Sound Merchantable Leaf Tobacco in Cask or any part thereof to him the said William hath not paid or in any sort Contented but the same to him the said W.m to pay or in any sort to Content hath hitherto altogether Refused and still doth Refuse to the Damages of him the said W.m Eleven Thousand Two Hundred and Eighty Eight Pounds of Good Sound Merchantable Leaf Tobacco and therefore suit is brought and so forth Pled.s &Ca And the afs.d Thomas by Henry Darnall his Attorney Comes and defends the force and Injury when &C.a and prays a hearing of the Writing Obligatory & it is Read he also prays a hearing of the Condition of the same Writing and it is Read unto him in these Words Vizt The Condition of the above obligation is such if the above bound Thomas Llanphier and James Freeman their Heirs Ex.rs or Adm.rs do or shall Cause to be paid unto the said W.m Middleton his Certain Attorney Ex.r Adm.rs or Assigns the full and Just Sum of Two Thousand Eight Hundred and Twenty Two pounds of Good sound Merchantable Leaf Tobacco in Cask in Charles County afs.d at or upon the Tenth day of February Next Ensuing the date hereof with Lawfull Interest for the same then the above obligation to be Void But if default be made in the payment of the said (Sum) |
