Court Anno Domini 1746
(55 Same Wardrop and Graham Remains against the said Charles Craycroft thereof undefended Therefore it is Considered that they the said Wardrop and Graham Recover against the said Charles his Debt & Costs afores.d and his Damages by occasion of Detaining that Debt to Two Hundred and Eighty one pounds of Tobacco to the same Wardrop & Graham on his assent by the Court Def.t in mea here adjudged and the said Charles in Mercy &Ca Mem.o the Plaintiffs Releases the Penalty on payment of Principal Interest and Damages
Called John Marten of Charles County Planter was Summoned to Answer unto George Maxwell of a plea that he render unto him the Just and full Sum of Ninety five pounds and Two pence Sterling which to him he owes and justly detains And Whereupon the said George Maxwell by Thomas Clark his Attorney Saith that whereas the said John on the Thirteenth day of April In the year of our Lord One Thousand Seven Hundred and forty Six at Charles County afs.d by his Certain Writing obligatory with the Seal of him the said John sealed and herein Court produced whose date is the day and year afs.d Acknowledged himself to be held and firmly bound unto the said George in the said Sum of Ninety five pounds and Two pence Sterling to be paid to the said George when thereunto afterwards he should be requested Nevertheless the said John altho' often Requested the Sum of Ninety five pounds and Two pence Sterling or any part thereof to him the said George hath not paid or in ay sort Contented but the same to him the said George To Pay or in any sort to Content hath hither to altogether Refused and Still doth Refuse to the Damage of him the said George One Hundred POunds Sterling and therefore suit is brought &Ca Pled.s &Ca And the said John by Jeremiah Chase his Attorney Comes and defends the force and Injury when &C.a and prays a hearing in the Writing Obligatory and is Read unto him he also prays a hearing of the Condition of the same Writing and it is Read unto him in these Words Viz.t The Condition of the above obligation is Such that if the above bound John Marten do and shall well and truly pay or Cause to be paid unto the said George Maxwell his Certain Attorney Ex.rs Adm.rs or Assigns the Just Sum of Forty Seven pounds Ten shillings and one penny sterling at or upon the first day of June Next Ensueing the Date hereof w.th Legal Interest for the same then the above obligation to be Void Else to remain in full force and Virtue in Law But if default be made in the payment of the said Sum of Forty Seven pounds Ten Shillings and one penny sterling then I Impower my attorney in any Court of Record in the Realms of Great Britain France or Ireland or within the province of Maryland or other his Majesties Dominions to appear for me at the suit of the abovementioned Geo Maxwell and to Receive a Declaration on the above obligation and thereupon to Confess Judgment by Nildicit Cognovit Actionem Nonsum informatus or otherwise hereby Releasing all the Errors that may happen upon the said Judgment suing out Execution thereupon or in any of the proceedings thereunto Relating (Which) |
