Charles County ss.t Charles Craycroft late of Charles County Planter otherwise Called Charles Craycroft of Charles County Planter was Summoned to answer unto Messrs Wardrop and Graham of a plea that he render unto them in the just sum of Six pounds Sterling which to them he owes and unjustly detains And Whereupon the said Mess.rs Wardrop & Graham by Thomas Clark their Attorney say that whereas the said Charles on the Twenty Seventh day of August In the year of our Lord one Thousand Seven Hundred and forty Six at Charles County afs.d by his Certain Writing Obligatory with the seal of him the said Charles Sealed and herein Court produced whose Date is the day and year afs.d acknowledged himself to be held and firmly bound unto them the said ^Mess.rs^ Wardrop and Graham in the ^s.d^ Sum of Six pounds Sterling to be paid to them the said Mess.rs Wardrop and Graham when thereunto afterwards he should be requested Nevertheless altho often Requested the said Sum of Six pounds Sterling or any part thereof to them the said Mess.rs Wardrop & Graham hath not paid or in any sort Contented but the sam to them the said Mess.rs Wardrop and Graham to pay or in any sort to Content hath hitherto Altogether Refused and Stil doth Refuse to the Damage of them the said Mess.rs Wardrop and Graham Twelve pounds Sterling and therefore suit is brought and so forth Pled.s &Ca And the said Charles by Jeremiah Chase his Attorney Comes and defends the force and Injury when &Ca a prays a hearing of the Writing Obligatory and it is Read unto him he also prays a hearing of the Condition of the same Writing and it is Read unto him in these words viz.t The Condition of the above obligation is such that if the above bound Charles Craycroft do and shall well and truly pay or Cause to be paid unto the said Mess.rs Wardrop and Graham their Certain Attorney Ex.rs Adm.rs or Assigns the Just and full Sum of Three Pounds Sterling money at or upon the first day of October Next Ensueing the date hereof with Legal Interest for the same then the above obligation to be Void Else to Remain in full force and Virtue in Law But if default be made in the payment of the said Sum of Three Pounds sterling and Interest then I Impower any Attorney in any Court of Belord in the Realms of Great Britain France or Ireland or within the province of maryland or other of his Majesties Dominions to appear for me at the suit of the above mentioned Wardrop and Graham to Receive a Declaration on the above obligation and there upon to Confess Judgment by Nildicit, Cognovit, Actionem, Nonsum Informatus or otherwise Hereby Releasing all the Errors that may happen when the said Judgment suing out Execution thereupon or is any of the Proceeding thereunto Relating Which being Read and heard the said Charles by his Attorney aforesaid Comes & Defends the force and Injury when &Ca and the said Attorney saith that he is not informed by the said Charles of any answer to be given for the said Charles to them the said Wardrop & Graham in the Premises nor hath he any other thing to say thereof in Barr or Preclusion of the Action aforesaid of them the said Wardrop & Graham whereby the (same |
