March Court Anno Domini 1746
(53 Whereupon it was Commanded the Sheriff that of the Goods Chattles and Credits of the said Thomas in his Bailywick being he should attach as well the Sum of Two pounds Three Shillings and Six pence Currency Damages as Five Hundred pounds of Tobacco for Costs that had Accrued and that further may Accrue in Prosecution of the Premises and when the same he had Attached or any part thereof that he should have it before the Justices of the Lord Proprietary of his Next County Court to be held at Charles Town on the Second Tuesday in March Next then and there to be Condemned according to Law to and for the use of the said Daniel Stephenson unless the said Thomas Davis Junior should Come then and there or his Lawfull Attorney and Answer unto the said Daniel Stephenson of a plea of Trespass upon the Case and that by Good and Lawfull men of his Bailywick he should make known to the Person or Persons in whose hands he should make the same Attachment that he she or they be and appear before the Justices of the said Lord Proprietary of the place and time afs.d to shew Cause if any he she or they have why the sum in their or any of their hands attached should not be Condemned according to law and the said Daniel Stephenson have thereof Execution if &C.a and how he should Execute that writ that he should make known to the Justices aforesaid at the Time and Place afs.d and that he should have then and there that Writ and the Names of those before whom he should make the same known &Ca And now here at this day to wit the Second Tuesday in March afs.d Comes the said Daniel by Jeremiah Chase Attorney and offers himself against the said Thomas in the plea aforesaid and the Sheriff aforesaid Returns to the Court here the Writ aforesaid thus Indorsed Viz.t Charles County ss.t I Hereby Certifie that by Virtue of the within writ to me Directed on the 10.th day of March 1746 I attached in the hands of Henry Moore the whole Damages & Costs and I have made Known to the Garnashee afs.d that he be & appear before the Justices of the said County Court at the time and place within Prescribed to shew Cause why the same Effects so attached in his hands should not be Condemned to and for the use within mentioned Daniel Stephenson before John Evans and John Hanson ys.t Two Good and Lawfull men of my Bailywick as I am hereby Comanded So Answers S Hanson She Whereupon the said Daniel Stephenson by his attorney afs.d Prays Condemnation of the Damages [illegible] so as afs.d attached in the hands of the said Henry Moore with Execution thereof to him to be adjudged and the s.d Henry ^Moore^ altho Solemnly Called Comes not but makes default Therefore it is Considered that the said Daniel have Condemnation of his Damages afs.d to Two pounds three Shillings and Six pence Currency as also the Sum of Two Hundred and fifty Nine pounds of Tobacco for his Costs and Charges by in and about the Premises laid out and Expended by the court here adjudged according to the force form and Effect of the Act of Assembly in those Cases late made and Provided and that the said Daniel have thereof Execution |
