Which being read and heard the said Henry by his attorney aforesaid Comes and defends the force and Injury when &C.a and the same attorney saith that he is not Informed by the same by the same Henry of any answer to make for the said Henry to the said Samuel in the action afs.d of the afs.d Samuel by which the same Samuel Remains against the said Henry thereof without Defence Therefore it is Considered that the said Samuel Hanson Junior Recover against the said Henry Jefferson his Debt aforesaid and his Damages by occasion of detaining that debt to Two Hundred and forty ^four^ pounds of Inspected Tobacco to the same Samuel of his assent by the Def.t in mea Court here adjudged and the said Henry in Mercy &Ca
Charles County ss.t James Beck late of Charles County Weaver otherwise Called James Beck of Charles County Weaver was summoned to answer unto Samuel Hanson Jun of a plea that he Render unto him the sum of Two Thousand Seven Hundred pounds of Tobacco which to him he owes & unjustly detains and so forth And Whereupon the same Samuel by Jeremiah Chase his Attorney saith that whereas the said James Beck on the Seventh day of September in the year of our Lord one Thousand seven Hundred and forty seven at Charles County aforesaid by his Certain Writing obligatory bound himself to the said Samuel in the said sum of Two Thousand seven Hundred Pounds of Tobacco to be paid to the said Samuel when after the said James Beck should be thereunto Requested Nevertheless the said James altho' often Required hath not Paid to the s.d Samuel the said sum of Two Thousand seven Hundred pounds of Tobacco nor any Part thereof but hitherto altogether hath and still doth Refuse to Pay the same to the Damage of the said Samuel Hanson Junior Five Thousand pounds of Tobacco and therefore suit is brought & so forth and he brings hereinto Court the said Writing obligatory which gives sufficient Testimony of the Debt aforesaid the date whereof is the day and year aforesaid John Doe Pled.s &C.a & Rich.d Roe And the aforesaid James Beck in his proper person COmes and defends the force and Injury when & so forth and prays a hearing of the Writing obligatory afs.d aforesaid and it is Read unto him in these words following to wit The Condition of the above obligation is such that if the abovebound James Beck do and shall well and truly pay or Cause to be paid unto the said Samuel Hanson Junior his Certain Attorney Executors Administrators or Assigns the Just and full sum of Thirteen Hundred and fifty Eight pounds of Tobacco and one shilling and Two pence Current (money) |
