(419) Money then the above obligation to be Void Else to Remain in full force and Virtue in Law But if default be made in the payment of the said sum of Thirteen Hundred & fifty Eight pounds of Tobacco and one shilling and Two pence Currency then I Impower any attorney in any Court of Record in the Realms of Great Britain France or Ireland or within the province of Maryland or other his Majestys Dominions to appear for me at the suit of the abovementioned Samuel Hanson Jun and to Receive a Declaration on the above obligation and thereupon to Confess Judgment p Nildicit Cognovit Actionem Nonsum informatus or otherwise hereby Releasing all the Errors that may happen upon the said Judgment suing out Execution thereupon or in any of the proceed.gs thereunto Relating On the Back of which Bond was the following Account Viz.t 1744 James Beck Dr 1745 Cr
Whereupon at the prayer of the said Samuel it is Ruled that the said James give special bail in the plea aforesaid and for want thereof the said James Present here & Court is Committed into the Custody of the sheriff Namely Thomas Hungerford Gent thereto Remain until &C.a And the said James in Custody as afs.d in his proper person aforesaid of him the said Samuel nor but that he owes to the said Samuel the sum of one Thousand four Hundred Pounds of Tobacco and one shilling and Two pence Currency and no more Therefore it is Considered by the Court here that the said Sam.l Recover against the said James his Debt aforesaid and his Damages by occasion of detaining that Debt to one Hundred and Ninety six pounds of Inspected Tobacco Def.t in mea to the same Samuel on his assent by the Court here adjudged and the said James in Mercy &C.a
Charles County ss.t John Cox late of Charles County Planter was attached to answer unto Samuel Hanson Junior of a plea of Trespass upon the Case and so forth And Whereupon the same Samuel Hanson Jun by Jeremiah Chase his attorney Complains that whereas the said John Cox on the fourteenth day of October in the year of our Lord One Thousand seven Hundred and forty seven at Charles County afs.d was Indebted to the said Samuel Hanson Junior in the sum of Three Thousand Six Hundred and forty one pounds of Tobacco for divers particulars lying properly in an (account) |
