(417) Which being Read and heard the said Thomas by Henry Darnall his attorney afs.d Comes and defends the force and Injury when &C.a and the same attorney saith he is not Informed by the same Thomas of any answer to make for the said Thomas to the said Samuel in the Action of the aforesaid Samuel by which the same Samuel Remains against the said Thomas thereof without Defence Therefore it is Considered that the said Samuel Recover against the said Thomas his Debt aforesaid and his Damages by occasion of detaining that Debt to Two Hundred Sixty one and a half pounds of Inspected Tobacco to the same Samuel Def.t in Mea of his assent by the Court here adjudged and the said Thomas in Mercy &Ca
Charles County ss.t Henry Jefferson late of Charles County Planter otherwise Called Henry Jefferson of Charles County Planter was summoned to answer unto Sam.l Hanson Junior of a plea that he Render unto him the sum of Thirteen Hundred pounds of Tobacco which to him he owes and unjustly detains and so forth And Whereupon the same Samuel by Jeremiah Chase his attorney saith that whereas the said Henry Jefferson the first Twenty fifth day of June in the year of our Lord One Thousand Seven Hundred and forty seven at Charles County aforesaid by his Certain Writing obligatory bound himself to the said Samuel in the said sum of Thirteen Hundred Pounds of Tobacco to be paid to the said Samuel when after the said Henry should be thereunto Requested Nevertheless the said Henry altho often Required hath not Paid to the said Samuel the said sum of Thirteen Hundred Pounds of Tobacco nor any Part thereof but hitherto altogether hath and still doth Refuse to pay the same to the Damage of the said Samuel Hanson Junior Two Thousand Six Hundred Pounds of Tobacco and therefore suit is brought and so forth and he brings hereinto Court the said Writing Obligatory which gives sufficient Testimony of the Debt aforesaid the date whereof is the day and year aforesaid John Doe Pled.s &C.a & Rich.d Roe And the aforesaid Henry Jefferson by Henry Darnall his attorney Comes and defends the force and Injury when &C.a and prays a hearing of the Writing obligatory afs.d & it is Read unto him and he also prays a hearing of the Condition of the said Writing obligatory and it is Read unto him in these words following to wit The Condition of the above obligation is such that if the above bound Henry Jefferson do and shall well and truly pay or cause to be paid unto the said Samuel Hanson Junior his Certain attorney Executors Adm.rs or assigns the Just and full sum of Six Hundred & Ninety Nine pounds of Tobacco at or upon the 20.th day of December Next Ensuing the date hereof with Legal Interest & for the same then the above obligation to be Void Else to Remain in full force and Virtue in Law but if Default be made in the payment of the said sum of six Hundred and Ninety Nine pounds of Tobacco then I Impower any attorney in any Court of Record in the Realms of Great Britain France or Ireland or within the province of Maryland or other his Majesties Dominions to appear for me at the suit of the above Obligation and thereupon to Confess Judgment by Nil dicit Cognovit Actionem Nonsum Informatus or otherwise hereby Releasing all the Errors that may happen upon the said Judgment suing out Execution thereupon or in any of the proceedings thereunto Relating (On) |
