(408) March Court Anno Domini 1747 Charles Books assigned the afs.d Note to the before mentioned James True and by the Indorsement ordered and appointed the afs.d John Cox to pay to the same James True the aforesaid sum of one Thousand Pounds of Tobacco Qualified as afs.d in the said Note specified according to the form and Effect of the same Note of which assignment the s.d John Cox afterwards to wit the day and year last mentioned at the County afs.d had Notice by Reason of the Premises also by force of the Statute in such Cases made and Provided the said John Cox became liable to and Chargeable with the payment of the said sum of one Thousand Pounds of Tobacco Qualified as afs.d according to the Tenor of the Note and Assignment afs.d and the said John Cox being so Chargeable in Consideration thereof afterwards to wit the day and year last abovesaid at the County afs.d assumed upon himself and to the same James True faithfully Promised that he the afs.d John would well and truly Pay and Content to the same James True the afs.d sum of one Thousand Pounds of Like Tobacco as afs.d when he should be thereunto afterwards Requested Yet the said John Cox his Promise and Assumption afs.d in form afs.d made not in the least Regarding but minding and fraudulently Intending him the said James True in this Part Craftilly and subtilly to deceive and defraud the said sum of one Thousand Pounds of Tobacco Qualified as afs.d to the said James True hath not Paid or in any sort Contented altho so to do the said John Cox was afterwards to wit on the first day of September in the Deny'd and still doth deny to the Damage of the said James True Two Thousand Pounds of Tobacco Qualified as afs.d and therefore suit is brought and so forth John Doe Pled.s &C.a & Rich.d Roe Whereupon at the Prayer of the said James True it Ruled that the said John Cox give special bail in the plea afs.d and for want thereof the said John Cox Present here in Court is Committed into the Custody of the sheriff Namely Thomas Hungerford Gentleman thereto Remain until &Ca And the said John Cox in Custody as afs.d in his proper Person Comes and defends the force and Injury when &C.a and saith that he Cannot deny the action aforesaid of him the said James True nor but that he owes to the said James True the sum of one Thousand Pounds of Tobacco as he above in declaring supposes Therefore it is Considered that the said James True Recover against the said John Cox his Damages afs.d to one Thousand Pounds of Tobacco above acknowledged as also Pounds of Inspected Tobacco for his Costs and Charges by him about his suit in this part laid out and Expended on his assent by the Court here Def.t in mea adjudged and the said John Cox in Mercy &Ca
Charles County ss.t Thomas Thompson Jun to schoolmaster late of Charles County Planter was attached to answer unto Joseph Aderton of a plea of Trespass upon the Case & so forth And Whereupon the same Joseph Aderton in his Proper Person Complains that whereas the said Thomas the fifth day of March in the year of our Lord one Thousand seven (Hundred) |
