(407) Charles County ss.t one the 2.d day of February 1747 Came M.r Lancelot Walker before me the subscriber one of his Lordships the Lord Proprietary's Justice of the peace for the County afs.d and made oath on the Holy Evangelists of Almighty God that the above account is just and true and that he Never Received any Pay or satisfaction or security for the same to the best of his knowledge Sworn before Rob.t Hanson And the aforesaid John by Henry Darnall his attorney Comes and defends the force and Injury when &C.a and Says that he Cannot Deny the action afs.d of him the said Robert nor but that he did assume upon himself in manner & form as the said Robert against him Complained nor also but that the said Robert hath sustained Damages by means of not Performing the Promises and assumptions to six Hundred sixty five and a half Pound of Tobacco as the said Robert above in declaring supposes Whereupon the said Robert by Jere Chase his attorney afs.d Prays Judgments and those Damages acknowledged together with his Costs and Charges by him about his suit in this Part laid out and Expended to him to be adjudged Therefore it is Considered by the Court here that the said Robert do Recover against the said John his Damages afs.d to six Hundred sixty five and a half Pound of Tobacco above acknowledged as also the sum of Two Hundred and Eight Pounds of Inspected Tobacco for his Costs & Charges by him about his suit in this part laid out and Expended on his Def.t in mea assent by the Court here adjudged and the said John in Mercy &Ca
Charles County ss.t John Cox son late of Charles County Planter was att.d to answer unto James True of a plea of Trespass upon the Case and so forth And Whereupon the said James by Jeremiah Chase his attorney Complains that whereas the said John Cox after the first day of May in the year of our Lord one Thousand seven Hundred and five to wit on the Third day of September in the year of our Lord one Thousand seven Hundred and forty five in Charles County afs.d made his Certain Note in Writing Called a promisary Note with his proper hand and mark thereto subscribed bearing date the same day and year aboves.d and then and there delivered the said Note to a Certain Charles Brooks Jun by which said Note the said John Cox sen obliged himself his Heirs or assigns to pay unto Charles Brook Jun.r his Hers or Assigns the full and just sum of one Thous.d Pounds of good sound Merchantable Tobacco in Cask to be paid By the fifteenth day of December Next Ensuing the date hereof it being for Value Received as by the said Note manifestly appears and the afs.d sum of one Thousand Pounds of Tobacco Qualified as afs.d as in the note afs.d or any Parcel thereof being not Paid and satisfied to the said Charles Brooks Jun the said Charles Brooke Jun.r to wit the fourth day of November In the year of our Lord one Thousand seven Hundred and forty five in the County afs.d by a Certain Indorsement in Writing then and there made on this Note and then and there subscribed with the proper hand mark and Name of the s.d (Charles) |
