(392) March Court Anno Domini 1747 Whereupon the said Daniel by Jeremiah Chase his Attorney afs.d all and singular the Previous Requisites by act of Assembly on Part of the said Daniel being Performed pray Judgment for the writt of the Lord Proprietary of Attachment to Issue Returnable here &C.a ag.st the Goods Chattles & Credits against the said Peter in the Jurisdiction of the Court here being for as well the Damages afs.d as for what Costs have accrued and that further may accrue in Prosecution of the Premises Therefore it is Considered by the Court here that the said Daniel have the Writt of the Lord Proprietary of Attachment Returnable here &C.a against the Goods Chattles & Credits of the said Peter within the Jurisdiction of the Court here being for as well teh sum of Eight Hundred Ninety four and Two Thirds of a pound of Tobacco as all Costs which to the sum have accrued in and about the Premises and that may hereafter accrue in Prosecution of the said Writt of Attachment by the Court here adjudged according to the form force and Effect of the act of Assembly aforesaid
Charles County ss.t Joseph Harrison late of Charles County Planter was attached to answer unto Samuel Hanson Junior of a plea of Trespass upon the Case and so forth And Whereupon the same Samuel by Jeremiah Chase his attorney Complains that Whereas the said Joseph Harrison the Twenty Nineth day of September in the year of our Lord One Thousand seven hundred and forty seven at Charles County afs.d was Indebted to teh said Samuel Hanson in the sum of Eighteen Hundred and fifty Three Pounds of Tobacco and Two Shillings and four pence Current money for divers Articles lying properly an account as by the Particular acc.t thereof herewith into Court brought may appear and being so thereof Indebted the afs.d Joseph in Consideration thereof afterwards to wit the day and year afs.d at the County afs.d upon himself assumed and to the said Samuel then and there faithfully Promised that he the afs.d Joseph Harrison the aforesaid sum of Eighteen Hundred and Fifty Three pounds of Tobacco and Two shill.s & four Pence Current money to the said Samuel when thereunto afterwards he should be requested well and truly would Content and Pay Nevertheless the afs.d Joseph his Promise & Assumption afs.d not Regarding but minding and fraudulently Intending the same Samuel in this Part craftily and Subtilly to deceive and defraud the afs.d Joseph the said sum of Eighteen Hundred & fifty Three Pounds of Tobacco and Two Shillings and four Pence Currency or any Part thereof to the same Samuel hath not Paid nor him for the same in any sort Contented altho' the afs.d Joseph afterw.ds to wit the first day of October in the year of our Lord one Thousand seven Hundred & forty seven and often afterwards Charles County afs.d by the same Samuel hath been Requested but the same to him hither to to Pay or him for the same in any sort to Content hath hither to altogether Refused and Still doth Refuse to the Damage of the same Samuel Hanson Three Thousand Seven Hundred and six pounds of Tobacco and four shillings and Eight Pence Currency and therefore Suit is brought & so forth John Doe Pled.s &C.a & Rich.d Roe 1744 Joseph Harrison D.r
