(393) Whereupon into Court herein his Proper Person Comes Samuel Hanson of Charles County Gentleman and becomes Pledge and security for the said Joseph that if it should happen the said Joseph in the plea afs.d should be Convict that then the said Samuel Hanson yeilded and Granted that as well the Damages afs.d as all Costs which to the said Samuel Hanson Jun in that this part should be adjudged of his Lands & Chattles should be made and Levied to and for the use of the said Samuel Hanson Jun that if it should happen that the said Joseph the Damages & Costs afs.d to the said Samuel Hanson Jun should not Pay or his Body into the Custody of the sheriff by Reason thereof Render And now here at this day to wit the Second Tuesday in March afs.d comes as well the said Joseph as the said Samuel by their Attorneys afs.d and the said Samuel by his attorney afs.d pray that the said Jo.s to his Declaration ^afs.d^ against him may answer and the said Joseph by his Attorney afs.d comes and defends the force and Injury when &C.a and the same attorney says that he is not Informed of any answer to the said Samuel for the said Joseph in the plea afs.d to be given and nothing other thereof does he say whereby the same Samuel Remains against the said Joseph thereupon with out Defence It is therefore Considered by the Court here that the said Samuel do Recover against the said Joseph His Damages by occasion of the Premises to Eighteen Hundred and fifty Three pounds of Tobacco and Two shillings and four Pence Currency as also Two Hundred & Nineteen Pounds of Tobacco before the Inspection Law & sixty Three Pounds of Inspected Tob.o for his Costs and Charges by him about his suit in this Part laid out and Expended to Def.t in mea the said Samuel of his assent by the Court here adjudged and the said Joseph in Mercy &Ca
It was Commanded the sheriff that he should take Hezekiah Swann late of Charles County Planter if &C.a and him safe keep so that you have his body before the Justices of the Lord Proprietary of his Next County Court to be holden at Charles Town on the Second Tuesday in March Next to answer unto John Jerly of a plea of Trespass upon the Case and so forth and that he should have then and there that Writt &Ca At which day to wit the Second Tuesday in March afs.d Comes the s.d John by Jeremiah Chase his Attorney and offers himself against the said Hezekiah and the Sheriff afs.d Namely Thomas Hungerford Gent Returns to the Court here that he has taken the body of the said Hezekiah Swann Whereupon into Court here in his Proper Person Comes Justinian Burch Jun.r of Charles County Planter and becomes Pledge and Security for the afs.d Hezekiah that if it should happen that the afs.d Hezekiah in the plea afs.d should be Convict that then the said Justinian Yeilded and Granted that as well the Damages aforesaid as all Costs which to the same John in this Part should be adjudged of his Lands and Chattles should be made and Levied to and for the use of the said John If it should happen the said Hezekiah (the) |
