March Court Anno Domini 1747
387 Whereupon It was Commanded the sheriff that of the goods Chattles & Credits of the afs.d Robert Minan in his Bailywick being he should Attach as well the sum of Ten Thousand four Hundred and six Pounds of Tobacco and Sixteen shillings and six pence Currency Damages as Three Thousand Pounds of Tobacco for Costs that had accrued and that further should accrue in Prosecution of the Premises and when the same he had attached or any Part thereof that he should have it before the Justices of the Lord Proprietary of his Next County Court to be held at Charles Town on the Second Tuesday in March Next then and there to be Condemned according to Law to and for the use of the said Robert Francklin unless the s.d Robert Minan should Come then and there by himself or Lawfull attorney and answer unto the said Robert Francklin of a plea of Trespass upon the Case and that by good and Lawfull men of his Bailywick he should make known to the Person or Persons in whose hands he should make the same attachment that he she or they be and appear before the Justices of the said Lord Proprietary at the Place and time afs.d to shew Cause if any he she or they have why the sum in their or any of their hands attached should not be Condemned According to Law and the said Robert Francklin have thereof Execution if &C.a and how he should Execute that writt that he should make known to the Justices afs.d at the Time and Place afs.d and that he should have then and there that that Writt and the Names of those before whom he should make the same known &Ca And now here at this day to wit the second Tuesday in March Comes the said Robert Francklin by Jeremiah Chase his attorney and offers himself against the said Robert Minan in the Plea afs.d and the sheriff afs.d Returns to the Court here the writt afs.d thus Indorsed Charles County ss.t I hereby Certifie that by Virtue of the within Writt to me Directed on the 18.th day of November 1747 I Attached in the hands of the within Named Robert Francklin sundry the Effects of the within Named Robert Minan amounting to 21£..18s..8D as p.r a schedule of Appraisment thereof hereunto annexed appears I further Certifie at the same time I attached in the hands of the said Robert Franklin the whole Damages and Costs within mentioned and also on the same day in the hands of W.m Talford for one Thousand pounds of Tobacco and also on the 1.st day of March 1747 I attached in the hands of John Payne for Nine Hundred Pounds of Tobacco I attached in their hands as of the Effects of the within named Robert Minan to and for the use of the said Robert Francklin and I have made known to the Garnashees abovementioned that they be and appear before the Justices afs.d at the time and Place within Prescribed to shew Cause if they or Either of them have why the said Effects so attached in their hands should not be Condemned for the use of the said Robert Francklin before Benjamin Davis John Cornish John Stone James Keck Jun and Thomas Price Good and Lawfull men of my Bailywick as I am hereby Commanded So Answers Tho.s Hungerford She With which Return was Returned the following schedule Vizt Charles County ss.t We the subscribers being summoned and sworn by the she of the said to Appraise and Value sundry goods and Effects as the Effects of a Certain Robert Minan and for the use of Robert Franklin do Appraise and Value the s.d Goods and Effects as follows Viz.t Given under our hands and seales this 18.th day of November 1747 |
