(371) Tuesday in June and he hath it and the same day is given to the same James here &Ca At which day to wit the Second Tuesday in June afs.d Comes here as well the said James as the said Thomas by their attorneys afs.d and the said Tho.s by his said attorney Prays further leave to Imparle hereto until the Next Court to be holden at Charles Town on the Second Tuesday in August and he hath it and the same day is given to the same James here &Ca At which day to wit the Second Tuesday in August afs.d Comes here as well the said James as the s.d Thomas by their attorneys afs.d and the said Thomas by his said attorney Prays further leave to Imparle hereto until the Next Court to be holden at Charles Town on the Second Tuesday in November and he hath it and the same day is given to the same James here &Ca At which day to wit the Second Tuesday in November afs.d Comes here as well the said James as the said Thomas by their attorneys afs.d and the said Thomas by his said attorney prays further leave to Imparle hereto until the Next Court to be holden at Charles Town on the second Tuesday in March and he hath it and the same day is given to the same James here &Ca And now here at this day to wit the second Tuesday in March afs.d Came here as well the said James as the said Thomas by their said attorneys afs.d and the said Thomas by his said attorney Comes and defends the force and Injury when &Ca Whereupon all & singular the Premises being by the Court here (According to the Directions of the Act of Assembly in such Cases late made and Provided fully seen heard and understood) and due deliberation thereup had It is adjudged and decreed that the s.d James Recover against the said Thomas as well the sum of four Pounds Currency for his Damages afs.d as also the sum of Pounds of Tobacco for his Costs and Charges by him about his suit in this part Def.t in mea laid out and Expended and the said Thomas in Mercy &Ca
This being an Action brought by the afs.d Margarett Perry against the afs.d Joseph Hynd for the Recovery of Damages by the said Margarett sustained by Reason of a Certain Trespass had made done & Committed by the said Joseph Hynd and the Inclosures of the s.d Margarett did Break Contrary to the form of the Act of Assembly in such Cases late made and Provided Thereupon the said Joseph was by Virtue of a Capias Ad Respondendum Returnable before his Lordships County Court on the second Tuesday in November in the year of our Lord one Thousand Seven Hundred & forty six arrested And the said Joseph by Henry Darnall his Attorney Comes and defends the force & Injury when &C.a and Prays leave to Imparle hereto until the Next Court to be holden at Charles Town on the second Tuesday in March and he hath it and the same day is given to the same Margarett here &Ca At which day to wit the Second Tuesday in March afs.d Comes here as well the said Margarett the said Joseph by their attorneys aforesaid and the said Joseph by this said attorney Prays further leave to Imparle hereto until the Next Court to be holden at Charles Town on the Second Tuesday in June & he hath it and the same day is given to the same Margarett here &Ca At which day to wit the Second Tuesday in June afs.d Comes here as well the said Margarett as the said Joseph by their attorneys aforesaid and the said Joseph by his said attorney (prays) |
