(363) Whereupon into Court here in his Proper Person Comes William Middleton of Charles County Merchant and becomes Pledge and Security for the said Thomas that if it should the said Thomas in the plea afs.d should be Convict that then the said William yeilded and Granted that as well the Damages ^afs.d^ as all Costs which to the same Edward in this part should be adjudged of his Lands & Chattles should be made and Levied to and for the use of the said Edward If it should happen the said Thomas the Damages and Costs afs.d should not Pay or his body into the Custody of the sheriff by Reason thereof Render And the said Thomas by Jeremiah Chase his attorney Comes and defends the force and Injury when &Ca and prays leave to Imparle hereto until the Next Court to be holden at Charles Town on the second Tuesday in March and he hath it and the same day is given to the same Edward here &Ca At which day to wit the second Tuesday in March afs.d Comes here as well the said Thomas as the said Edward by their attorneys afs.d and the said Thomas by his said attorneys Comes and Prays further leave to Imparle hereto until the Next Court to be holden at Charles Town on the second Tuesday in June and he hath it and the same day is given to the same Edward here &Ca At which day to wit the Second Tuesday in June aforesaid Comes here as well the said Thomas as the said Edward by their attorneys afs.d and the said Thomas by his said attorney Prays further leave to Imparle hereto until the Next Court to be holden at Charles Town on the Second Tuesday in August and he hath it and the same day is given to the same Edward here &Ca At which day to wit the Second Tuesday in Aug.st afs.d Comes here as well the said Thomas as the said Edward by their attorneys afs.d and the said Thomas by his said attorney Prays further leave to Imparle hereto until the Next Court to be holden at Charles Town on the Second Tuesday in November and he hath it and the same day is given to the same Edward here &Ca At which day to wit the Second Tuesday in November afs.d Comes here as well the said Thomas as the said Edward by their attorneys afs.d and the said Edward by his said Attorney Prays further leave to Imparle hereto until the Next Court to be holden at Charles Town on the Second Tuesday in March and he hath it and the same day is given to the same Edward here &Ca And now here at this day to wit the Second Tuesday in March afs.d Came as well the said Thomas as the said Edward by their attorneys afs.d Whereupon all and Singular the Premises being by the Court here (according to the Directions of the Acts of Assembly in such Cases late made & Provided fully seen heard and understood) and due Deliberation thereupon had It is Adjudged and Decreed that the said Edward take Nothing by his Writt afs.d Def.t in mea but he and his Pledges of Prosecuting be in Mercy &Ca and the said Thomas go thereof without Day &C.a It is likewise Considered that the said Thomas Cawood do Recover against the said Edward Trafford Pounds of Tobacco for his Costs and Charges by him about his defence in this part sustained to the same Thomas Cawood at his Request by the Court here adjudged to the form force and Effect of the statute in those Cases late made and Provided and that the same Thomas Cawood have thereof Execution |
