Judgment for Plaintiffs

Charles County ss.t  James Marr Senior late of Charles County Planter otherwise
Called James Marr senior of Charles County was summoned to answer unto
James Middleton & Ignatius Gardiner of a Plea that he Render unto them the full
and Just sum of one Thousand Eighty and Six pounds of Good Clear well
Qualified Tobacco in hh.d and four pounds Ten shillings and five pence Currency
which to them he owes and unjustly detains and so forth

    And Whereupon the same James & Ignatius by Philip Key their
Attorney says that whereas the afs.d James Marr on the Eleventh day of August in
the year of our Lord one Thousand Seven Hundred and forty Six at Charles County afs.d
within the Jurisdiction of this Court by his Certain Writing obligatory Sealed with
the seale of him the said James Marr and now hereunto the Court the date
whereof is the same day and year obliged himself his Heirs Ex.rs to pay unto James
Middleton and Ignatius Gardiner the Executors of Vincent Askin Deceased the
sum of one Thousand Eight and Six pounds of good Clean well Qualified Tobacco in
Hh.d and four Pounds Ten Shillings and five pounds Currency on Demand for Value Reced
for the use of the Creditors or Legetees  Nevertheless the afs.d James Marr altho
often times Required hath not Paid the afs.d one Thousand Eighty and six pounds of
Good Clean well Qualified Tobacco and four Pounds Ten shillings and six ^five^ pence Curr.y
as aforesaid to them the said James and Ignatius or any part thereof but hitherto
altogether Refused hath and still doth Refuse to pay the same wherefore them the s.d
James and Ignatius say they are the worse and have Damage to the Value of Two
Thousand one Hundred and Seventy Two pounds good Clean well Qualified Tobacco
and Nine pounds and Ten pence Currency and therefore they bring suit & so forth

And the said James Marr by Henry Darnall his Attorney Comes &
defends the force and Injury when &C.a and prays leave to Imparle hereto until the
Next Court to be holden at Charles Town on the Second Tuesday in March and he
hath it and the same day is given to the same James & Ign.s Ex.rs afs.d here &C.a

At which day to wit the Second Tuesday in March afs.d Comes here as well the said
James and Ignatius Ex.rs afs.d as the said James Marr by their attorneys afs.d &
the said James Marr by his said attorney Prays further leave to Imparle hereto
until the Next Court to be holden at Charles Town on the second Tuesday in
June and he hath it and the same day is given to the same James & Ig.s Ex.rs afs.d here &Ca

At which day to wit the Second Tuesday in June afs.d Comes here as well the said
James & Ignatius Ex.rs afs.d as the said James Marr by their attorneys afs.d and the s.d
James Marr by his said attorney Prays further leave to Imparle hereto until the
Next Court to be holden at Charles Town on the Second Tuesday in August and he
hath it and the same day is given to the same James & Ign.s Executors afs.d here &Ca

At which day to wit the Second Tuesday in August afs.d Comes here as well the said
James & Ignatius Ex.rs afs.d as the said James Marr by their attorneys afs.d and the s.d
James Marr by his said attorney Prays further leave to Imparle hereto until the
Next Court to be holden at Charles Town on the Second Tuesday in August and he
