(354) March Court Anno Domini 1747
This being an action upon the Case for the Recovery of Damages according to the Directions of the act of Assembly of this Province against the Transportation of Persons out of the Province without Passes brought by the said John Hanson Ys.t against the said Henry Thompson Whereupon the said Henry was by virtue of a Capias ad Respondendum Returnable before his Lordships County Court on the Second Tuesday in August in the year of our Lord Seventeen Hundred and forty six arrested Thereupon the said John Produces the Bond afs.d in the words following Vizt Charles County ss.t Know all men by these Presents that I Daniel Brown of Charles County Innholder am held and firmly bound unto John Hanson Ys.t in the full & Just sum of Three Thousand Eight Hundred and Fifty Two Pounds of Tobacco to be paid to the s.d John Hanson Ys.t his Heirs or Assigns to which payment well and truly to be made and done I bind my self my Heirs Ex.rs and Administrators in the whole and for the whole firmly by these presents sealed with my seal and dated this 15.th Day of February Anno Dom 1744 The Condition of the above obligation is such that if the above bound Daniel Brown his Heirs Ex.rs or Administrators do pay or Cause to be paid unto the above ment.d John Hanson Ys.t his Heirs or Assigns the sum of one Thousand Nine Hundred & Twenty Six pounds of Tobacco in Cask Convenient in Charles County at or upon the 15.th day of March Next Ensuing then the above obligation to be void and of no Effect but if default be made on the payment of the above said sum of one Thousand Nine Hund.d and Twenty Six pounds of Tobacco Quallified as afs.d by the time above Perfixt then I Impower any attorney practising in any the Court of Record within this province to appear for me and in my Name to Confess Judgment for the first above mentioned sum of one Thousand Nine Hundred and Twenty six pounds of Tobacco by Nihil Dicit Cognovit Actionem Nonsum Informatus or otherwise hereby Releasing all the Errors that may happen in Rendering said Judgment Issuing out Execution or any the Proceedings thereto witness my hand and seale the day and year above written Signed Sealed and Delivered his In Presence of us Daniel D Brown (S) Corn.s Sandford mark Peter Contee And the said Henry by Philip Key his attorney Comes and Defends the force and Injury when &C.a and prays leave to Imparle hereto until the Next Court to be holden at Charles Town on the Second Tuesday in November and he hath it and the same day is given to the same John here &Ca At which day to wit the Second Tuesday in November afs.d Comes here as well the said John Hanson ys.t as the said Henry by their attorneys afs.d and the said Henry by his said attorney prays further leave to Imparle hereto until the Next Court to be holden at Charles Town on the Second Tuesday in March and he hath it and the same day is given to the same John here &Ca At which day to wit the Second Tuesday in March afs.d Comes here as well the said John as the said Henry by their attorneys afs.d and the said Henry by his said attorney prays further leave to Imparle hereto until the Next Court to be holden at Charles Town on the Second Tuesday in June and he hath it and the same day is given to the same John here &Ca At which day to wit the Second Tuesday in June afs.d (Comes) |
