Court Anno Domini 1747
Charles County ss.t John Muschett late of Charles County Merchant was attached to answer unto Theophilus Swift Clerk of a plea of Trespass upon the Case And whereupon the said Theophilus by Philip Key his Attorney Complains for that whereas the said John on the fifth day of August In the year of our Lord one Thousand Seven Hundred and forty five at Charles County afs.d was Indebted unto the said Theo.s In the sum of Twenty Pounds Eighteen shillings and Two pence Currency for divers Particulars lying properly in account as by a Particular Accompt thereof herewith into Court brought may appear and the said John being so thereof Indebted in Consideration thereof Afterwards to wit the say and year afs.d in the County afs.d upon himself assumed and to the same Theophilus then and there faithfully Promised that he the said John the said sum of Twenty Pounds Eighteen Shillings and Two pence Currency afs.d would well and truly Content and Pay when thereunto afterwards he should be requested Nevertheless the said John his Promise and Assumption afs.d in form afs.d and in the least Regarding but minding and fraudulently Intending him the said Theophilus in this Part craftily and subtilly to deceive and defraud the said John the said sum of Twenty Pounds Eighteen Shillings and Two pence Currency or any Part thereof to him the said Theophilus hath not Paid or in any sort Contented altho so to do the said John was on the Eighteenth day of June In the year of our Lord one Thousand Seven Hundred and forty Six and often before & since at Charles County afs.d by the said Theophilus Requested but the said John the s.d Sum of Twenty Pounds Eighteen Shillings and Two pence Currency or any part thereof to him the said Theophilus to pay or in any sort to Content hath hither to altogether REfused and Stil doth Refuse to the Damage of him the said Theophilus Forty one Pounds sixteen shillings and four pence Currency and therefore he brings suit &Ca John Doe Pled.s &C.a & Rich.d Roe 1744/5 John Muschett to Theophilus Swift D.r
Charles County ss.t On the 21.st February 1745 Came the Reverend M.r Theophilus Swift and made oath on the Holy Evangelists of Almighty God that to the best of his knowledge (the above Account is Just and true as it stands stated and that he Hath Received no part or parcel thereof nor any security or satisfaction for the same Before Walter Hanson And the said John by Jeremiah Chase his Attorney Comes and defends the force and Injury when &Ca and prays leave to Imparle hereto until the Next Court to be holden at Charles Town on the second Tuesday in November and he hath it and the same day is given to the same Theophilus here &Ca At which day to wit the Second Tuesday in (November) |
