(35) Maryland ss.t Prince Georges County January 30.th 1746/7 Then Came M.r John Lawrance (Attorney in fact for Edward Trafford Esq.r of Liverpoole) before me the subscriber one of his Lordships Justices of the peace for the County aforesaid and made oath on the Holy Evangelists of Almighty God that the within account is just and true and that he hath not Received part or percel nor any security or other satisfaction for the same Jurat Coram me Jno Hawkins Junr I hereby ^Certifie^ that Luger B in which the within account stands stated to January 20.th 1745/6 was Legally prov'd as the Law Directs February 6.th 1745/6 Before my self Jno Hawkins Junr And the said William in his Proper Person Comes and defends the force and Injury when &Ca and saith that he Cannot deny the Action aforesaid of him the said Edward nor but that he did Assume upon himself in manner and form as the said ^Edward^ against him have Complained nor also but that the said Edward have sustained Damage by means of not Performing the Promises and Assumptions afs.d to fourteen Hundred and Eleven p.ds of Tobacco as the said Edward above in Declaring supposes Whereupon the said Edwd by Henry Darnall his Attorney afs.d and prays Judgment and those Damages so Acknowledged together with his Costs and Charges by him about his suit on this part laid out and Expended to him to be Adjudged Therefore it is Considered by the Court here that the said Edward do Recover against the said William his Damages afs.d to fourteen Hundred and Eleven pounds of Tobacco as above Acknowledged as also the sum of Two Hundred and Eighty Two pounds of Tobacco for his Costs and Charges by him about his suit in this part laid out and Expended Def.t in mar on his assent by the Court here Adjudged and the said William in Mercy &Ca
Charles County ss.t William Speak late of Charles County Planter was Attached to answer unto Edward Trafford Esq.r of a plea of Trespass upon the Case And Whereupon the said Edward by Henry Darnall his Attorney Complains that whereas the said William on the Eighth day of March In the year of our Lord one Thousand Seven Hundred Forty and five at Charles County afs.d was Indebted unto the said Edward In the Sum of Two Thousand four Hundred and Twenty five pounds of Tobacco for divers Particulars lying Properly In Account as by the Particular Account thereof herewith into Court brought may appear and the said William being so thereof Indebted In consideration thereof afterwards (to wit) the day and year afs.d at the County aforesaid upon himself assumed and to the same Edward then and there faithfully Promised that he the said William the said Sum of Two Thousand four Hundred and Twenty five pounds of Tobacco to the said Edward would (well |
