36) March Court Anno Dom 1746

Well and truly would Content and pay when thereunto afterwards he should be
Requested Nevertheless the said William his Promise and Assumption afs.^d
in form afs.^d made not in the least Regarding but minding and fraudulently
Intending him the said Edward In this part Craftily and subtilly to deceive and
defraud the said William the said sum of Two Thousand four Hundred Twenty and
five pounds of Tobacco or any part thereof to him the said Edward hath not paid or
in any sort Contented altho so to do the said William was on the third day of Oct.^o
In the year of our Lord One Thousand Seven Hundred and forty six and often before
and since at Charles County aforesaid by the said Edward Requested but the s.^d
William the said Sum of Two Thousand four hundred & Twenty five pounds of Tob^o
or any part thereof to him the said Edward to pay or in any sort to Content hath
hitherto altogether Refused and still doth Refuse to the Damage of him the said
Edward four Thousand Eight Hundred and Fifty pounds of Tobacco and therefore
suit is brought and so forth Pled.^s &C.^a
