(281) Here to until the Next Court to be holden at Charles Town on the Second Tuesday in June Next and he hath it and the same day is given to the ^same^ Falkner & Muschett here &Ca At which day to wit the second Tuesday in June afs.d Comes here as well the said Falkner & Muschett as the said Thomas by their Attorneys afs.d & the s.d Thomas by his said attorney prays further leave thereof to Imparle hereto until the Next Court to be holden at Charles Town on the Second Tuesday in august Next and he hath it and the same day is given to the same Falkner & Muschett Here &Ca At which day to wit the Second Tuesday in August afs.d Comes here as well the said Falkner & Muschett as the said Thomas by their attorneys afs.d and the said Thomas by his said attorney prays further leave thereof to Imparle hereto until the Next Court to be holden at Charles Town on the Second Tuesday in November Next and he hath it and the same day is given to the same Falkner & Muschett here &ca And Now here at this day to wit the second Tuesday in November aforesaid Comes as well the said Falkner & Muschett by their attorney afs.d as the said Thomas by his attorney aforesaid and the said Tho.s by his Said Attorney Comes and defends the force and Injury when &Ca and the said Falkner & Muschett by their attorney afs.d pray Judgment and their Damages afs.d against the afs.d Thomas and for that the said Thomas does not Gainsay It is therefore Considered by the Court here that the said Falkner and Muschett do Recover against the said Thomas their Damages by occasion of the Premises (and which by the Justices of the Court here are asest) to four pounds Currency as also Three Hundred and Twenty Seven pounds of Tobacco for his Costs and Charges by him about their Suit in this part laid out and Expended to the same Falkner & Muschett of their assent by the Court here adjudged and the same Thomas Def.t in mea in Mea &C.a
Charles County ss.t And Whereupon the same Samuel by Jeremiah Chase his attorney Complains that whereas the said Francis Demarr being an Inhab^i^tant of the province of Maryland to wit at Charles County afs.d did on the Sixth day of November in the year of our Lord one Thous.d Seven Hundred and forty four at Charles County afs.d Pay away and Dispose of unto the s.d Saml Hanson ^in^ the Tob.o House of a Certain Tho.s Hussey Luckett at Cha.s Co.ty afs.d one hogshead of Tob.o weighing Gross Eight Hundred and Ninety Two p.ds of Tobacco Tare Eighty pounds of good Sound Merchantable Leaf Tob.o for Goods before that time at Cha.s Co.ty afs.d had & bought of the said Samuel Hanson by the said Jeremiah which said Tob.o so paid away and Disposed of to the said Samuel the said Francis ought to have Security & Kept for and during the space of one whole year commencing from the Time the Tobacco was Received which was on the afs.d sixth day of Nov.r in the year afs.d by the same Samuel Hanson in a good tight House with a good Door lock & Key according to the form of the Act of Assembly in such Cases Provided Nevertheless the said Francis Demarr not Ignorant of the premises but minding and fraudulently Intending the same Samuel in this part craftily and subtilly to deceive & defraud the (said) |
