Court Anno Domini 1747 Thousand seven Hundred and forty six at Charles County afs.d by his Certain Writing obligatory with the seal of him the said William sealed and herein Court produced whose date is the day and year afs.d acknowledged himself to be held & firmly bound unto the said George In the sum of Three Thousand one Hundred & sixty five pounds of Tobacco as afs.d to the said George when there unto afterw.ds he should be requested Nevertheless the said William altho often Requested the said Sum of Three Thousand one Hundred and sixty five pounds of Tob.o as afs.d or any part thereof to him the said George to pay or in any sort to Content hath hitherto altogether Refused and still doth Refuse to the Damage of him the said George Ten Thousand pounds of Tobacco as afs.d therefore suit is brought & so forth John Doe Pled.s &Ca & Rich.d Roe And the afs.d William by Jeremiah Chase his attorney Comes & defends the force and Injury when &C.a and prays a hearing of the Writing obligatory and it is Read unto him he also prays a hearing of the Condition of the same Writing and it is Read unto him in these Words following Vizt The Condition of the above obligation is such that If the above bound W.m Eaton do well and truly pay or Cause to be paid unto the said George Maxwell his Certain Attorney Ex.rs Adm.rs or assigns the Just & full Sum of Fifteen Hundred & Eight Two pounds Merchantable Leaf Tobacco Convenient to Benedict at or upon the first day of July Next Ensuing the date hereof with Legal Interest for the same then the above obligation to be Void Else to Remain in full force & Virtue in Law but If default be made in the payment of the said sum of Fifteen HUndred & Eighty Two Pounds Merchantable Leaf Tobacco Then I Impower any Attorney in any Court of Record in the Realms of great Britain France or Ireland or within the province of Maryland or his Majesties Dominions to appear for me at the suit of the above mentioned George Maxwell and to Receive a Declaration on the above obligation & thereupon to Confess Judgment by Nildicit Cognovit Actionem Nonsum Informatus or otherwise hereby Releasing all the errors that may happen upon the said Judgment living out Execution thereupon or in any of the proceedings thereunto Relating Which being Read and heard the said William by his attorney afs.d Comes & defends the force & Injury when &C.a and the same attorney saith that he is not Informed by the said William of any answer to make for the said W.m to the said George in the action of the afs.d George by which the same George Remains against the said W.m Thereof without Defence Therefore it is Considered that the said Geo Recover against the said W.m his Debt afs.d and his Damages by occasion of detaining that Debt to Two Hundred and Eighty one pounds of Tobacco to the same George Def.t in Mea his assent by the Court here adjudged and the said William in Mercy &C.a Memorandum the plaintiff Releases the penalty on payment of 1483½ w.th Interest & Costs |
