November Court Anno Domini 1747
275 Paid unto the said Samuel his Certain attorney Ex.rs Adm.rs or assigns the Just sum of one Thousand & six pounds of Tobacco before the first day of July Next ensuing the date hereof then the above obligation to be Void Else to Remain in full force & Virtue in Law but if default be made in the payment of the said sum of one Thousand & six pounds of Tobacco then I Impower any attorney in any Court of Record in the Realms of great Britain france or Ireland or within the province of Maryland or other his Majesties Dominions to appear for me at the suit of the above said Samuel Hanson and to Receive a Declaration on the above obligation & thereupon to Confess Judgment by Nildicit Cognovit Actionem Nonsum Informatus or otherwise hereby Releasing all the Errors that may happen upon the said Judgment suing out Execution thereupon or in any of the proceedings thereunto Relating On the Back of which Bond was the following Account Vizt 1744 Patrick Conner D.r
Which being Read and heard the said Patrick by his attorney afs.d Comes and Defends the force and Injury when &C.a and the same attorney saith that he is not Informed by the same Patrick of any answer to make for the said Patrick to the said Samuel in the action of the afs.d Samuel by which the same Samuel Remains against the said Patrick thereof without defence Therefore it is Considered that the said Samuel Recover against the said Patrick his Debt afs.d and his Damages by occasion of detaining that Debt to Two Hundred and Eighty one pounds of Tobacco to the same Samuel of his assent by the Court here adjudged & the s.d Def.t in Mea Patrick in mercy &C.a
Charles County ss.t William Eaton late of Charles County Planter otherwise Called William Eaton of Charles County Planter was summoned to answer unto Geo: Maxwell of Charles County Merchant of a plea that he render unto him the Just & full sum of Three Thousand one Hundred and sixty five pounds Merchantable LEaf Tobacco COnvenient to Benedit which to him he owes & unjustly detains & so forth And Whereupon the said George in his proper person saith that whereas the said William on the Twenty fourth day of June in the year of our Lord one (Thousand) |
