(274) November Court Anno Domini 1747 Obligation to be Void Else to Remain in full force & Virtue in Law but if default be made in the payment of the said sum of Nine pounds Nine shillings sterling then I Impower any attorney in any Court of Record in the Realms of Great Britain France or Ireland or within the province of Maryland or other his Majesties Dominions to appear at the suit of the above Mentioned Luke Morriss & to Receive a declaration on the above obligation and thereupon to Confess Judgment by Nildicit Cognovit Actionem Nonsum Informatus or otherwise hereby Releasing all the Errors that may appear upon the said Judgment suing out Execution thereupon or in any of the proceedings thereunto Relating Which being Read and heard the said John by his attorney afs.d Comes and defends the force & Injury when &C.a and the same attorney saith that h is Informed by the same John of any answer to make for the said John to the said Luke Morriss in the action of the afs.d Luke by which the same Luke Remains against the said John there without Defence Therefore it is Considered that the said Luke Recover against the said John his Debt afs.d and his Damages by occasion of detaining that Debt to Two Hundred and Eighty one pounds of Tobacco to the same Luke of his Def.t in Mer assent by the Court here adjudged and the said John ^in^ Mercy &C.a
Charles County ss.t Patrick Conner late of Charles County Planter otherwise Called Patrick Conner of Charles County Planter was summoned to answer unto Samuel Hanson Jun.r of a plea that he Render unto him the Just sum of Two Thousand & Six pounds of Tobacco which to him he owes and unjustly detains & so forth And Whereupon the same Samuel Hanson Jun.r by Jeremiah Chase his attorney saith that whereas the said Patrick on the sixth day of February in the year of our Lord one Thousand Seven Hundred and forty Six at Charles County afs.d by his Certain Writing obligatory with the Seal of him the said Patrick Sealed and herein Court produced whose date is the day and year afs.d acknowledged himself to be held & firmly bound unto the said Samuel In the sum of Two Thousand & Six pounds of Tob.o to the said Samuel when thereunto afterwards he should be requested Nevertheless the said Luke ^Patrick^ altho often Requested the said sum of Two Thousand & six pounds of Tob.o or any part thereof to him the said Samuel Hanson Jun.r to pay or in any sort to Content hath hitherto altogether Refused and still doth Refuse to the damage of him the said Samuel Hanson Jun.r Four Thousand & Twelve Pounds of Tobo and therefore suit is brought and so forth John Doe Pled.s &Ca & Rich.d Roe And the afs.d Patrick by Henry Darnall his attorney Comes & defends the force & Injury when &C.a and prays a hearing of the Writing obligatory and it is Read unto him in these Words Vizt The Condition of the above obligation is such that if the above bound Patrick Conner do and shal well & truly pay or Cause to be (paid) |
