(273) Which being Read and heard the said Jeremiah Aderton by his attorney afs.d Comes and defends the force and Injury when &C.a and says nothing in Barr or preclusion of the action of the aforesaid John Fitz whereby the same John Remains against to the said Jeremiah undefended Therefore it is Considered that the afs.d John Recover against the said Jeremiah Aderton his Debt afs.d & his Damages by occasion of detaining that Debt to four Hundred & Eighty One Pounds of Tobacco to the same John of his assent by the Court here Def.t in Mea adjudged and the said Jeremiah in Mercy &Ca
Charles County ss.t John Macpherson late of Charles County and ^in the^ Province of Maryland Planter otherwise Called John Mcpherson of Charles County & province of Maryland Planter was Summoned to answer unto Luke Morriss of the City of Philidelphia Merchant of a plea that he Render unto him the Just & full sum of Eighteen Pounds Eighteen shillings sterling Money of great Britain which to him he owes and unjustly Detains and so forth And Whereupon the same Luke by JChase his attorney saith that whereas the said John on the Thirteenth day of April in the year of our Lord one Thousand seven Hundred and forty seven at Charles County afs.d by his Certain Writing obligatory with the seal of him the said John sealed and herein Court produced whose date is the day and year afs.d acknowledged himself to be held & firmly bound unto the said Luke in the sum of Eighteen pounds Eighteen shillings sterling money as afs.d to the said Luke when thereunto afterwards he should be Requested Nevertheless the said John often Requested the said sum of Eighteen Pounds Eighteen shillings sterling money as afs.d or any part thereof to him the said Luke to pay or in any sort to Content hath hitherto altogether Refused and still doth Refuse to the Damage of him the said Luke Morriss Thirty seven Pounds sixteen shillings sterling money as afs.d & therefore suit is brought & so forth John Doe Pled.s &C.a & Rich.d Roe And the afs.d John by Henry Darnall his attorney Comes & Defends the force & Injury when &C.a and prays a hearing of the Writing obligatory and it is Read unto him he also prays a hearing of the Condition of the same Writing and it is Read unto him in these Words Vizt The Condition of the above obligation is such that if the above bound John Macpherson do and shall well & truly pay or Cause to be paid unto the s.d Luke Morriss his Certain Ex.rs adm.rs or assigns the Just Sum of Nine pounds Nine shillings sterling Money of great Britain at or before the first day of October Next Ensuing the date hereof with Legal Interest for the same then the above (obligation) |
