(271) Unto Mess.rs Stephenson & Steel of a plea that he Render unto them the Just & full sum of seventeen Hundred and seventy Eight Pound of Tobacco which to them he owes and un Justly detains and so forth And Whereupon the same Mess.rs Stephenson & Steel by Jeremiah Chase their Attorney say that whereas the said Thomas Green on the Twelfth day of November In the year of our Lord One Thousand seven Hundred and forty six at Charles County afs.d within the Jurisdiction of this Court by his Bill obligatory sealed with the seal of him the said Thomas and here in Court brought thereunto whereof is the day and year afs.d acknowledged himself to one and be in debted to the said Mess.rs Stephenson & Steel the sum of Eight Hundred and sixty four pounds of Tobacco in one Hogshead in Charles County to be paid unto the said Stephenson & Steel their Certain attorney Ex.rs or adm.rs or assigns on the first day of December Next Ensuing the date hereof to which payment well and truly to be made I bind my Self my Heirs Ex.rs & Adm.rs in the penal sum of seventeen Hundred and Twenty Eight Pounds of Tobacco firmly by these presents to them the said Mess.rs Stephenson & Steel In fact Declares that the said Thomas Green did not to pay to them the said Mess.rs Stephenson & Steel the said sum of Eight Hundred and sixty four pounds of Tobacco on the said Twelfth day of November then Next Ensuing the date of the said Bill obligatory according to the Intent and purport of the Bill obligatory aforesaid whereby an action hath accrued to the said Mess.rs Stephenson & Steel to Demand and have of the s.d Thomas Green the said sum of seventeen Hundred and Twenty Eight Pound of Tobacco Nevertheless the said Thomas Green altho' often Requested to wit on the first day of October In the year of our Lord One Thousand Seven Hundred and forty seven and often since at Charles County afs.d to the same Stephenson & Steel hath not paid ^to^ them the said Mess.rs Stephenson and Steel Seventeen Hundred and Twenty Eight pounds of Tobacco or any Part thereof but hitherto altogether hath and still doth Refuse to pay the same whereof them the said Mess.rs Stephenson & Steel by that they are the Worse and hath Damage to the Value of Three Thousand four Hundred and fifty six pounds of Tobacco and therefore they bring suit & so forth John Doe Pled.s &C.a & Rich.d Roe And the aforesaid Thomas in his proper person Comes and defends the force & Injury when &C.a & says that he Cannot deny the Action afs.d of them the said Stephenson & Steel nor but that he owes to them the sid Mess.rs Stephenson & Steel the afs.d sum of Seventeen Hundred and Twenty Eight Pounds of Tobacco ^in manner & form as^ to the same Mess.rs Stephenson & Steel above against him Complains Therefore it is Considered by the Court here that the s.d Stephenson & Steel do Recover against the said Thomas his Debt afs.d and his Damages by occasion of detaining that Debt to Two Hundred and Eighteen Pounds of Tobacco to the same Stephenson & Steel on their assent by the Court here adjudged and the s.d Def.t in mea Thomas Green in Mercy &Ca |
