Anno Domini 1747 And the aforesaid John Macpherson in his proper person Comes and defends the force and Injury when &C.a and Says that he Cannot deny the action afs.d of him the s.d Daniel Stephenson nor but that that he did assume upon himself in manner & form as the said Daniel above against him hath Complained nor also but that the said Daniel hath sustained Damages by means of not Performing the Promises & Assumptions afs.d to Eight Hundred and Seventy Seven pounds of Tobacco as the said Daniel above in declaring supposes Whereupon the said Daniel by Jeremiah Chase his Attorney afs.d prays Judgment and those Damages so acknowledged together with his Costs & Charges by him about his suit in this part laid out and Expended to him to be adjudged Therefore it is Considered by the Court here that the said Daniel do Recover against the said John his Damages afs.d to Eight Hundred and Seventy Seven pounds of Tobacco above acknowledged as also the Sum of Two Hundred and Twenty five pounds of Tobacco for his Costs & Charges by him about his Sut in that part laid out and Expended on his assent by the Court here adjudged and the said Def.t in mea John in Mercy &C.a
Charles County ss.t Thomas Cooksey late of Charles County Planter otherwise Called Thomas Cooksey of Charles County PLanter was summoned to answer unto Samuel Hanson Jun of Charles County in the province of Maryland Gent of a plea that he Render unto him the just & full sum of Two Thousand and Twenty four Pounds of Good Tobacco which to him he owes & unjustly Detains & so forth And Whereupon the same Samuel Hanson Jun by Jeremiah Chase his atty saith that whereas the said Thomas on the Twelfth day of March in the year of our Lord one Thousand Seven Hundred and forty Six at Charles County afs.d by his Certain Writing Obligatory with the seal o fhim the said Thomas Sealed and here in Court produced whose date is the day and year afs.d Acknowledged himself to be held and firmly bound unto the s.d Samuel In the Sum of Two Thousand and Twenty four Pounds of Good Tobacco afs.d to the s.d Samuel when thereunto afterwards he should be requested Nevertheless the said Thomas altho' often Requested teh said sum of Two Thousand and Twenty four pounds of Good Tobacco as afs.d or any part thereof to him the said Samuel to pay or in any sort to Content hath hitherto altogether Refused and still doth Refuse to the Damage of him the said Samuel Four Thousand and Forty Eight pounds of Tobacco as afs.d and therefore suit is brought & so forth John Doe Pled.s &C.a & Rich.d Roe And the afs.d Thomas by Thomas Clark his attorney Comes & Defends the force & Injury when &C.a and prays a hearing of the Writing obligatory and it is Read unto him he also Prays a hearing of the Condition of the same Writing & it is Read unto him in these Words following Vizt (The) |
