November Court Anno Domini 1747
(259) The Condition of the above Obligation is such that if the above bound Thomas Cooksey do well and truly pay or Cause to be paid unto the said Samuel Hanson Jun his Certain attorney Ex.rs adm.rs or assigns the just and full sum of one Thousand P.ds of Good Tobacco in one Cask Convenient in said County at or upon the 18.th day of April Next Ensuing the date hereof with Legal Interest for the same then the above obligation to be Void Else to Remain in full force & Virtue in Law but if Default be made in the Payment of the said sum of one Thousand pounds of Tobacco in form afs.d then I do hereby Impower any attorney in any Court of Record in the Realms of Great Britain France or Ireland or with in the Province of Maryland or other his his Majesties Dominion to appear for me at the suit of the above mentioned Saml Hanson Jun and to Receive a Declaration on the above obligation & thereupon to Confess Judgm.t by Nildicit Cognovit Actionem Nonsum Informatus or otherwise hereby Releasing all the Errors that may happen upon the said Judgment suing out Execution thereupon or in any of the proceedings thereunto Relating On the Back of which bond was the following account Vizt 1744 Thomas Cooksey D.r C.r
Whereupon into Court here in his proper person Comes John Estep of Cha.s Co.ty Gent & becomes plede & security for the afs.d Thomas that if it should happen that the aforesaid Thomas in the plea afs.d should be Convict that then the said John Yielded and Granted that as well the Debt aforesaid as all Damages which to the same Samuel in this part should be adjudged of his Lands & Chattles should be made & Levied to and for the use of the said Samuel if it should happen the said Tho.s the Debt & Damages aforesaid to the said Samuel should not Pay or his body into the Custody of the sheriff by Reason thereof Render And the aforesaid Tho.s Cooksey by Thomas Clark his attorney Comes and defends the force & Injury when &C.a and saith that he Cannot deny the Action afs.d of him the said Sam.l nor but that he owes to the said Samuel the sum of Two Thousand & Twenty four Pounds of Tobacco & no more Therefore it is Considered by the Court here that the said Samuel do Recover against the said Tho.s his Debt afs.d and his Dam.s by occasion of detaining that Debt to Three Hundred & forty four Pounds of Tob.o to the sum Def.t in Mea Sam.l on his Assent by the Court here adjudged and the said Thomas Cooksey in Mercy &C.a |
