The Court here that the said Alexander do Recover against the said W.m
his Damages afs.d to Two pounds fifteen shillings and seven pence sterling
above acknowledged as also the Sum of one Hundred and Ninety Two p.ds
of Tobacco for his Costs & Charges by him about his Suit in that part laid out
and Expended on his Assent by the Court here adjudged and the said in
Def.t in Mer   Mercy &Ca

Charles County ss.t     John Boswell son of Michael late of Charles Co.ty
                                  Planter was attached to answer unto Christopher
                                  Lowndes & Company of a plea of Trespass upon the Case

And Whereupon the said Chris.r Lowndes & Company by Henry Darnall
their Attorney Complain for that whereas the said John on the sixth day of Jany
In the year of our Lord one Thousand Seven Hundred and forty Six at Charles Co.ty
afs.d was Indebted unto the said Chris.r & Com in the sum of Eight Hundred and
Seventy Eight Pounds of Tobacco for divers particulars lying properly in account as
by a particular account thereof herewith into Court brought may appear and the said
John being so thereof Indebted in Consideration thereof afterwards to wit the day
and year afs.d in the County afs.d upon himself Assumed and to the same Chris.r & Com
then & there faithfully Promised that he the said John the said sum of Eight Hundred
and Seventy Eight pounds of Tobacco to the said Chris.r & Com would well & truly
Content and pay when thereunto afterwards he should be requested  Nevertheless
the said John his Promise and assumption afs.d in form afs.d made not in the least
Regarding but minding and fraudulently Intending them the said Chris.r & Com
in this part craftily and subtilly to deceive and defraud the said John the said
sum of Eight Hundred and Twenty Eight pounds of Tobacco or any part thereof to
the said Chris.r & Com hath not paid or in any sort Contented altho so to do the s.d
John was on the first day of September In the year of our Lord one Thousand
Seven Hundred and forty seven and often before & since at Charles County afs.d by
the said Chris.r & Com Requested but the said John the said sum of Eight Hundred
and seventy Eight Pounds of Tobacco or any part thereof to the said Chris.r & Com to
Pay or in any sort to Content hath hither to altogether Refused and Stil
doth Refuse to the Damage of the said Chris.r & Com One Thousand Seven
Hundred and Fifty Six pounds of Tobacco and therefore they Bring
