(244) November Court Anno Domini 1747 Lawfull Persons of my Bailywick as I am hereby Commanded So answers Sam: Hanson she Whereupon the said William by Jeremiah Chase his attorney afs.d Prays Condemnation of the sum of Eight Hundred & forty Eight pounds of Tobacco so as afs.d Attached in the hands of the said Joseph King with Execution thereof to him to be Adjudged and the said Joseph King altho solemnly Called Comes not but makes default Therefore it is Considered by the Court here that the said William have thereof Condemnation of the same afs.d in the hands of the Garnashee afs.d attached by the Court here adjudged according to the form force and Effect of the Act of Assembly in those Cases late made & provided and that the said William Middleton have thereof Execution &Ca Mem.o attachment struck off as to the other Garnashee JChase Secy on Cond
It was Commanded the sheriff that he should take William Wood late of Charles County Planter if &C.a and him safe keep so that he should have his body before the Justices of the Lord Proprietary of his Next County Court to be holden at Charles Town on the second Tuesday in November Next to answer unto Alexander Black of a Plea of Trespass upon the Case and so forth and that he should have then & there that Writ &Ca At which day to wit the second in November afs.d Comes the said Alexander by Jeremiah Chase his attorney and offer himself against the said William and the sheriff afs.d Namely Sam.l Hanson Gent Returns to the Court here that he has taken the body of the s.d William Wood And the afs.d William in his proper person Comes and defends the force & Injury when &C.a and says that he Cannot deny the Action afs.d of him the said Alexander nor but that he did assume upon himself in manner & form as the said Alexander ^above^ against him hath Complained nor also but that the said Alexander hath sustained Damages by means of not Performing the Promises & Assumptions afs.d to Two pounds fifteen shillings and seven pence sterling as the said Alexander above in Declaring Supposes Whereupon the said Alexander by Jeremiah Chase his Attorney afs.d prays Judgment and those Damages so acknowledged together with his Costs & Charges by him about his suit in this part laid out & Expended to him to be adjudged Therefore it is Considered by (the) |
