(243) Warren for the Use of the afs.d William Middleton according to the Directions of the Act of Assembly in Such Cases made and Provided hereof fail not Given under my hand and seal the Day and year abovesaid To Arthur Lee Mr Edmund Porteus Clk of Charles County Whereupon It was Commanded the sheriff the of the Goods Chattles & Credits of the afs.d Thomas Warren in his Bailywick being he should attach as well the sum of Six Hundred Hundred and Seventy Nine pounds of Tob.o Damages as four Hundred Pounds of Tobacco for Costs that had accrued and so that further should accrue in prosecution of the Premises and when the same he had attached or any part thereof that he should have it before the Justices of the Lord Proprietary of his Next County Court to be held at Charles Town on the Second Tuesday in November Next then & there to be Condemned according to Law to & for the use of the said William unless the said Thomas should come then & there by himself as Lawfull attorney and answer unto the said William of a plea of Trespass upon the Case and that by Good & Lawfull men of his Bailywick he should make Known to the person or persons in whose hands he should make the same attachment that he she or they be and appear before the Justices of the said Lord Proprietary at the place and Time afs.d to shew Cause if any he she or they have why the sum in their or any of their hands attach should not be Condemned according to Law and the said William have thereof Execution if &C.a and how he should Execute that Writ that he should make known to the Justices afs.d at the Time and place afs.d and that he should have then and there that Writ and the Names of those before whom he should make the same known &C.a Andrew here at this day to wit the second Tuesday in November afs.d Comes the said William by Jeremiah Chase his attorney and offers himself against the said Thomas In the plea afs.d and the sheriff afs.d Returns to the Court here the Writ afs.d there Indorsed Charles County ss.t To the Worshipfull the Justices within Mentioned I hereby Certifie that by Virtue of the within Writ to me Directed that on the 7.th day of October 1747 I attached in the hands of Joseph King the sum of Eight Hundred & fifty Pounds of Tobacco and on the same day in the hands in the hands of Rich.d Smith four Hundred Pounds of Tobacco as the Effects of the within Nam'd Thomas Warren and for the use of the within Mentioned William Middleton and have made known to the abovementioned Garnishees that they be and appear at the Time & Place with in Prescribed to shew Cause if any they have why the said Effects so att.d by their hands should not be Condemned for the use of said William Middleton according to Law attached before Jane Penn & John Howard good & (Lawful) |
