November Court Anno Domini 1747
(241) Forty five pounds of Tobacco the Twenty Eighth day of October and in the hands of John Wedding for one Hundred and five pounds of Tobacco on the fifth Day of November and in the hands of William Speak for one Hundred pounds of Tobacco on the fifth Day of November and in the hands of John Marten Sen for Three Hundred and forty pounds of Tobacco November the 3d and in the hands of John More for for Two Hundred and Eighty pounds of Tobacco and I have made known to the Garnashees above mentioned that they be and appear before the Justices aforesaid at the Time and place prescribed to shew Cause why the said Effects so attached in their hands should not be Condemned according to Law before William Hungerford Wm Middleton Jun.r Thomas Smoot William Hungerford William Middleton Jun Geo Harley Francis Montgomery and William Middleton Jun Robert Middleton James Griffin George Adams William Middleton Jun Good & Lawfull men of my Bailywick So answers Tho.s Hungerford Sher Whereupon the said William Bryan by Jeremiah Chase his attorney aforesaid prays Condemnation of the Effects afs.d so as afs.d attached in his hands to Two pounds Eleven Shillings and Nine pence Currency & Nine Hundred seven and a half pounds of Tobacco to him to be adjudged and the said Mark altho' solemnly called comes not but makes Default And the said James Boarman the said sum of one Hundred and Sixty Pounds of Tobacco altho Solemnly Called Comes not but makes Default and the said Peter Montgomery the sid sum of one Hundred and forty five pounds of Tobacco altho solemnly Called Comes not but makes default and the said John Wedding the said sum of one Hundred & five pounds of Tobacco altho' solemnly Called Comes not but makes default and the said William Speak the said sum of one Hundred pounds of Tobacco altho' solemnly Called Comes not but makes Default and the said John Marten Sen the sum of Three Hundred & forty p.ds of Tobacco altho solemnly Called Comes not but makes Default And the afs.d Cha.s Courts in to Court here in his proper person Comes & Confesses that at the time of laying the attachment afs.d he had and stil has of the Effects of the s.d Mark Knowles to the Value of Two Hundred and seventy five pounds of Tobacco and no more the said John Moore in like manner Confesses Two Hundred and Eighty pounds of Tobacco and no more and the said Thomas Levisin like Confesses six Shillings Currency and no more Whereupon the s.d William Bryan by Jeremiah Chase his attorney aforesaid prays Condemnation of the several sums of Tobacco & money afs.d so as afs.d in the hands of the Several Garnashees afs.d and by them Confessed & by Default with Execution thereof to him to be adjudged (Therefore) |
