Upon himself and to the same George then and there faithfully Promised that he
the said John Sum of one Thousand and fifty Two Pounds of Tobacco
to the said George would well and truly Content and pay when thereunto
afterwards he should be Requested Nevertheless the said John his Promise and
Assumption aforesaid in form afs.d made not in the least Regarding but minding &
fraudulently Intending him the said George In this part cratfily and subtilly to
deceive and defraud the said John the said Sum of One Thousand and fifty Two
Pounds of Tobacco or any part thereof to the said George hath not paid or in any sort
Contented Altho so to do the said John was on the first day of December In the year of
our Lord one Thousand seven Hundred and forty six and often before and Since
at Charles County afs.d by the said George Requested but the said John the said
sum of one Thousand and fifty Two pounds of Tobacco or any part thereof to
the said George to pay or in any sort to Content hath hither to altogether Refused
and Still doth Refuse to the Damage of the said George Two Thousand One Hund.d
and four pounds of Tobacco and therefore he brings Suit &Ca             John Doe

And the said John in his proper person Comes and defends the force &
Injury when &C.a and and saith that he Cannot deny the action afs.d of him the s.d
George Tarvin nor but the he did assume upon himself in manner & form
as the said George against him Hath Complained nor also but that the said
George hath sustained Damage by manes of not performing the promises &
assumptions afs.d to one Thousand and fifty Two pounds of Tobacco as the said
George above in Declaring supposes
                                                                      Whereupon the said George by
Henry Darnall his attorney afs.d prays Judgment and those Damages so
Acknowledged together with his Costs and Charges by him about his suit in this
part laid out and Expended to him to be adjudged
