(230) November Court Anno Domini 1747 Therefore it is Considered by the Court here that the said ^Geo:^ do Recover against the said John his Damages afs.d to One Thousand and fifty Two pounds of Tob.o above acknowledged as also the sum of Two Hundred and seventy Six p.ds of Tobacco for his Costs and Charges by him about his suit in that part laid out and Expended on his assent by the Court here adjudged and the said Johnson Def.t in Mer Mercy &Ca
Charles County ss.t Thomas Hungerford late of Charles County Planter was attached to Answer unto Robert Gilpin of a plea of Trespass upon the Case and so forth And Whereupon the same Robert by Jeremiah Chase his Attorney Complains that Whereas the said Thomas Hungerford the Twenty first day of August in the year of our Lord One Thousand Seven Hundred and forty Seven at Charles County afs.d was Indebted to the said Robert in the sum of One Thousand five Hundred and sixty seven pounds of Tobacco for such articles as by properly in an account as by the Particular Account thereof herewith into Court brought may appear and being so thereof Indebted the said Thomas in Consideration thereof afterwards to wit the day & year afs.d at the County afs.d upon himself assumed and to the said Robert then & there faithfully promised that he the said Thomas the said sum of one Thousand five Hundred & Sixty seven pounds of Tobacco to the said Robert when thereunto afterwards he should be Requested well and truly would Content and pay Nevertheless the said Thomas Hungerford his Promise and Assumption afs.d not Regarding but minding & fraudulently Intending the same Robert in this Part craftily and subtilly to deceive and defraud the said Thomas the said sum of one Thousand five Hundred & Sixty seven pounds of Tobacco or any part thereof to the said Robert hath not paid nor him for the same in any sort Contented altho the said Thomas afterwards to wit the Twenty fifth day of August in the year and at the County afs.d & often since by the said Robert hath been thereunto Requested but the same to him hitherto to Pay or him for the same in any sort to Content the said Thomas Hungerford hath hitherto Altogether Refused and still doth Refuse to the Damage of the said Robert Gilpin Three Thousand One Hundred and Thirty four pounds of Tobacco and therefore he brings suit & so forth John Doe Pleds.s &C.a & Rich.d Roe
