Anno Domini 1747
(217) January 1.st 1745/6 Then Came before the Subscriber one of his Lordships Justices of the peace for Charles County the above Named John Manniree and proved the above account according to Law Before Robt Hanson Whereupon into Court here in his proper person Comes George Thomas of Charles County Planter and becomes pledge and Security for the afs.d John Ratcliffe that if it should happen that the afs.d John Ratcliffe in the plea afs.d should be Convict that then the s.d George Yeilded & Granted that as well the Debt afs.d as all Damages which to the same John Manniree in this part should be adjudged of his Lands and Chattles should be made and levied to and for the use of the said John Manniree if it should happen the said John Ratcliffe the Debt and Damages aforesaid to the said John Manniree should not Pay or his body into the Custody of the sheriff by Reason thereof Render And the said John Ratcliffe by Thomas Clark his attorney comes and defends the force and Injury when &C.a and prays leave thereof to Imparle hereto until the next Court to be holden at Charles Town on the second Tuesday in June Next and he hath it and the same day is Given to the same John Manniree here &Ca At which day to wit the second Tuesday in June afs.d Comes here as well the said John Manniree as the said John Ratcliffe by their attorneys afs.d and the said John Ratcliffe by his said attorney prays further Leave to Imparle hereto until the Next Court to be holden at Charles Town on the Second Tuesday in August Next and he hath it and the same day is given to the same John Manniree here &Ca At which day to wit the second the second Tuesday in August afs.d Comes here as well the said John Manniree as the said John Ratcliffe by their attorneys afs.d and the said John Ratcliffe by his said attorney prays further Leave to Imparle here to until the Next Court to be holden at Charles Town on the second Tuesday in November Next and he hath it and the same day is given to the same John Manniree here &Ca And now here at this day to wit the second Tuesday in November afs.d came as well the said John Ratcliffe as the said John Manniree by their attorneys afs.d and the said John Manniree by his attorney afs.d prays that the said John Ratcliffe to his Declaration afs.d ^against him^ may answer and the said John Ratcliffe by his attorney afs.d comes and defends the force and Injury when &C.a and the same attorney says that he is not Informed of any Answer to the said John Manniree for the said John Ratcliffe in the plea afs.d to be given and nothing other thereof does he say whereby the same John Manniree Remains against the said John Ratcliffe thereupon with out Defence It is therefore Considered by the Court here that the said John Manniree do Recover against the said John Ratcliffe his Damages by occasion of the Premises to Eight Hundred and Eighty Pounds of Tobacco as also Two Hundred & fifty Pounds of Tobacco for his Costs & Charges by him about his suit in this part laid out & Expended to the said John manniree of his assent by the Court here adjudged and the said John Def.t in mear John Ratcliffe in Mercy &Ca |
