(216) November Court Anno Domini 1747 Form as the said Edward above against him hath Complained nor also but that the said Edward hath Sustained Damages by means of not performing the Promises and Assumptions aforesaid to Twenty Pounds Sterling as the afs.d Edward above supposes Whereupon the said Edward by his Attorney afs.d prays Judgment and those Damages so acknowledged together with his Costs & Charges by a about his suit in this part sustained to him to be adjudged Therefore it is Considered that the said Edward Recover against the said James his Damages to Twenty Pounds Sterling above acknowledged and also Three Hundred and Twenty pounds of Tobacco for his Costs & Charges by him about his suit in this part laid out and Expended on his assent Def.t in mer by the Court here adjudged and the said James in Mercy &Ca
Charles County ss.t John Ratcliffe late of Charles County Joiner was attached to answer unto John Manniree of a plea of Trespass upon the Case And Whereupon the said John Manniree by Jeremiah Chase his attorney Complains for that whereas the said John Ratcliffe of the Nineth day of January in the year of our Lord One Thousand Seven Hundred and forty four five at Charles County afs.d was Indebted unto the said John Manniree the sum of Eight Hundred and Eighty p.ds of Tobacco for divers particulars lying properly in Account as by a particular account being herewith into Court brought may appear and the said John Ratcliffe being whereof Indebted in Consideration thereof afterwards to wit the day and year afs.d in the County afs.d upon himself assumed and to the same John Manniree then and there faithfully promised that he the said John Ratcliffe the said sum of Eight Hundred and Eighty p.ds of Tobacco to the said John Manniree would well and truly Content and pay when thereunto afterwards he should be requested be Requested Nevertheless the said Jn.o Ratcliffe his promise and assumption afs.d in form afs.d made nothing the least Regarding but minding and fraudulently Intending him the said John Manniree on this part craftily & subtilly to deceive and defraud the said John Ratcliffe the said sum of Eight HUndred and Eighty Pounds of Tobacco or ay part thereof to the said John Manniree hath not paid or in any sort Contented altho so to do the said John Ratcliffe was on the Twenty fifth day of February In the year of our Lord one Thousand seven Hundred & forty Six and often before and since at Charles County aforesaid by the said John Manniree Requested but the said John Ratcliffe the said sum of Eight Hundred and Eighty p.ds of Tobacco or any part thereof to the said John Manniree to pay or in any sort to Content hath hither to altogether Refused and still doth Refuse to the Damage of him the said John Manniree seventeen Hundred and Sixty pounds of Tobacco and therefore he brings suit & so forth John Doe Pled &C.a & Rich.d Roe John Ratcliffe D.r Contra C.r Jan.y 9.th 1744/5 To a years Board 800 To paid George Tarvin for 2/ all 80 880 Errors Excepted his p John I Mannery mark |
